Committee on Planning Hawaii County Council 25 Aupuni Street Hilo, HI 96720 Dear Ms. Leithead-Todd: Subject: Rezoning application (REZ 00-007), TMK: 7-7-7:29; Applicant- Glen & Melitta Hodson At the County Planning Commission meeting May 7, 1999, a number of residents (including myself and wife) of the Keauhou iJka subdivision, objected to the subject rezoning. Their petitions in opposition and statements are on record. Reasons given for opposition included further noise, increased traffic, safety of children walking on Nohealani Street, and the substandard feeder street, Walua Road. It appears that the Hodsons, knowing full-well the zoning on their property when purchased, are speculators who wish to profit at the expense of imposing negative externalities on their neighbors. In its turn, the County can expect future increases in real estate taxes as a result of this rezoning. However, the County may be assuming a financial risk when it does not recognize its inconsistency in application of existing County code regulations. Years ago the County approved the subdivisions of Kuakini Heights and Keauhou iJka in violation of the County's code for subdivision that addresses the feeder street(s) to a new subdivision. The access or feeder streets, Akoni, Kam III extension and Walua Road do not meet a number of County code requirements. These violations include among others: grade limits, sight distances, and roadway width. Approval of the subject rezoning would be another violation of the County's code relative to feeder streets. Is a small violation really a "violation"? It seems that it is about time for the County to decide whether it intends to abide by its own codes or not. If not, the County ~ (pyb`b declared its various codes, not as requirements, but simply "guidelines" for loose interpretation. A consistent policy is long overdue and needed.
