RESOLUTION NO. 619 18
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF REAL
PROPERTY FOR THE COUNTY OF HAWAII DEPARTMENT OF PUBLIC WORKS
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one
fiscal year be approved by resolution; and
WHEREAS, the County of Hawai`i Department of Public Works ("DPW") currently rents
parking and storage space for its facility in Kealakekua, identified as a portion of TMK:
(3) 8-1-016-039, situated at 81-6394 Hawai`i Belt Road, Kealakekua, County and State of Hawai`i,
from the Estate of Ole Eigel Jensen and Elaine Marie Jensen ("Landlord"); and
WHEREAS, DPW continues to need this parking and storage space for the near future and so
desires to enter into a multi-year lease agreement commencing on August 1, 2018, and ending
April 30, 2020, with the option to renew the lease for two (2) additional five (5) year terms with
Landlord; and
WHEREAS, DPW is requesting authorization for the Mayor to enter into a multi-year lease
agreement with Landlord for parking and storage space; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Honorable Harry Kim, Mayor of the County of Hawai`i, is hereby authorized to enter into a multi-year
Lease with the Estate of Ole Eigel Jensen and Elaine Marie Jensen, for a term beginning
August 1, 2018, and ending April 30, 2020, with the option to renew the lease for two (2) additional
five (5) year terms, at the monthly rate of seven hundred and 00/100 ($700.00).
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of the Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to:
(1) Mayor Harry Kim; (2) Department of Finance; (3) Department of Public Works; (4) Craig T.
Masuda, Deputy Corporation Counsel, Section Chief; and (5) Elaine Marie Jensen, P.O. Box 390293,
Keauhou, Hawai`i 96739.
