PUBLIC ON AGENDA ITEMS: (There were none.) CHR. EOFF: We have one item on our agenda and it is Bill 147. Clerk, please read Bill 147. BILLS FOR The Chair directed the Committee to proceed to the next order of business, ORDINANCES: Bills for Ordinances. PC -25 May 21, 2018 Bill 147: AMENDS SECTION 25-8-33 (CITY OF HILO ZONE MAP), ARTICLE 8, CHAPTER 25 (ZONING) OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS AMENDED), BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL — TWENTY ACRES (A -20a) TO AGRICULTURAL — SIX ACRES (A -6a) AT KAUMANA HOMESTEADS, KAUMANA AND PONAHAWAI, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEYS: 2-5-047:033 AND 2-5-047:034. (ADDlicant: Kellv and Joanne Jarneski) (Area: 40 acres) The Windward Planning Commission forwards its favorable recommendation for this change of zone, which would allow the applicant to apply for a six -lot subdivision on 40 acres of land located at the intersection of Kaumana Drive and Akolea Road. Upon final subdivision approval, the applicant intends to continue living in the existing dwelling and sell the remaining five lots. Reference: Comm. 919 Intr. by: Ms. Eoff (B/R) Motion to Approve: Ms. O'Hara moved to pass Bill 147 on first reading. Seconded by Ms. David. CHR. EOFF: I would like to ask the applicant, Mr. Jarneski, and his agent or consultant, Ms. Mikkelson, to please come forward. Would you like the give more background? (Note: At this time, applicant Kelly Jarneski and Consultant Lori Mikkelson came forward to address the members of the Committee.) CHR. EOFF: Before we ask Council Members if they have any questions or concerns, would you like the give us a little bit more background, either one of you? Just introduce yourself first. MS. MIKKELSON: My name is Lori Mikkelson, and I've been working with Kelly for a while to get this going. Anyway, he came to me and asked if we could do this, and we did the research and this is something that he's looking forward to doing. He has interest in extended family and friends who are interested in sort of making it a homestead area, a small farm for families. CHR. EOFF: Okay. MR. JARNESKL My name is Kelly Jarneski. I got a kind of big parcel up there. Actually, it's likeI have three 20's. So one 20, I have a house my dad lives on and I have the other two 20's. I'm on one 20 and I have family and friends that sort of want to live like that. They want their own little farms for the kids and that type of living. So at this point, I met up with Lori and we decided that whatever we can do, you know, and this is to the point where we decided like six -acre Page 2 PC -25 May 21, 2018 parcels and a little bigger so that they can do their own thing, raise their own cows, raise their own fruits, vegetables, and live that type of life. Sort of like I've lived like that all my life, and it's like we're close. We're not far away, we're like seven—like my dad said, we have a farm life in the city. So basically, that's what it is, we're just like seven minutes away from everything, from the hospital. So, we're close to everything and yet they can raise their children in that manner, which is kind of like a rare thing nowadays. CHR. EOFF: Thank you. I'm just going to add that the Windward Planning Commission had a favorable recommendation as well as the Director, correct? MR. JARNESKL Right. CHR. EOFF: Council Members, we have Jeff Darrow, the Planning Program Manager from the Planning Department as well as Shancy Watanabe who is a Land Use Planner also. So, Council Members, do you have any questions or concerns? MR. CHUNG: Yeah, this property is situated in the district which I represent and I concur with the Windward Planning Commission's decision on this matter. It's not inconsistent with all of the other properties in that area. I think it's going to be a good thing actually. I mean we can't be retaining all of these big parcels, especially as Mr. Jarneski said, this is actually, really in the urban core, yet even if it's on the outlying areas. So, I wholeheartedly support it. CHR. EOFF: Thank you, Mr. Chung. Ms. David. MS. DAVID: Thank you, Chair. I'd like to also say thank you for your intentions and what you explained. It not only addressesI think in this day and age, while we talk about the need for housing for people and also the need to be self-sufficient in engaging in some sort of agriculture too. I think your intent is very honorable and I think you've addressed an important need in this community. So, I congratulate you and I will be supporting your application. Thanks. CHR. EOFF: Thank you, Ms. David. Mr. Richards. MR. RICHARDS: Thank you, Chair. I too, will be supporting this. I'm just curious, did you reach out to the neighbors? I assumed you did, talk story about what the plans are. MS. MIKKELSON: Not only have we reached out to the neighbors but also the neighbors have reached out to us, and there's been some interest in further subdividing their own parcels up there. So, there has been a lot of support and very little of anything else. Page 3 PC -25 May 21, 2018 MR. RICHARDS: Okay. I just, again, I look to the representing Councilman as far as support and the Planning Commissions, and obviously, all that's favorable. I'm always concerned about neighbors and neighboring impact. So, with that, I'll be supporting it. Thank you. CHR. EOFF: Thank you. Ms. Lee Loy. MS. LEE LOY: Thank you, Chair. Thank you, Mr. Jarneski. I really am liking how innovative this model of ownership subdivision along with homesteading and ag opportunities. I'm actually looking forward to seeing more of this coming forward, this sustainable model. I'm also liking the conditions of approval, specifically condition D, which provides a successor or assigns to notify new purchasers and tenants about the farming opportunities along with condition L, which is restrictive covenants regarding the zoning of the parcel and where you can build. Just very innovative. This is something I can look forward to and maybe even encourage some of the adjacent property owners. Thank you, Ms. Mikkelson, for bringing something like this forward. I think this is the new way forward, so, thank you. I yield. CHR. EOFF: Thank you, Ms. Lee Loy. Mr. Chung. MR. CHUNG: Just to address Mr. Richards' concern, I did also reach out to some of the people in the neighboring area, and yeah, they have no problem whatsoever with this rezoning. In fact, they've also represented that the Jarneski's, both Kelly and his dad, are just really outstanding members of that whole community. I didn't hear of any opposition there, actually, all support. CHR. EOFF: Okay, thank you, Mr. Chung. Any other comments, Council? Seeing none, thank you very much forPlanning, did you have anything you wanted to add? Okay, thank you. Then I'll take a vote. All in favor, please say aye. ff Vote on Bill 147: The motion to recommend passage of Bill 147 on first (Approved) reading was carried by the following voice vote: Ayes: Committee Members Chung, David, Kanuha, Lee Loy, O'Hara, Poindexter, Richards, Ruggles, and Chair Eoff — 9. Noes: None. Absent: None. Excused: None. CHR. EOFF: Motion carries and this rezoning will be forwarded to the County Council with a favorable recommendation, and that'll be in about two weeks.
