Re: Resolution to authorize exemption of certain Code requirements—Mohouli Heights

Enclosed is a resolution authorizing the exemption of certain code requirements related to Phase 3-
92 of the Mohouli Heights Senior Neighborhood project in order to develop additional housing
units.
The Office of Housing and Community Development (OHCD) requests that this resolution be
waived from the Finance Committee and be placed on the July 11, 2018 Council agenda in order to
meet critical deadlines related to the developer's financing of this project. If there are any

A. REQUEST:
Please prepare a resolution authorizing the exemption of certain code requirements, pursuant to
Section 201 H-38 of the Hawaii Revised Statutes for Phase 3-92 of the Mohouli Heights Senior
Neighborhood.
The Office of Housing and Community Development respectfully request that the above-referenced
matter be waived from Committee to the full Council for action at the next Council meeting, hopefully,
July 11, 2018.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Resolution 536-16 subsequently approved the zoning classification of the Original Parcel to RM
Three Thousand ("RM-3"), and allowed for the total development of 182 units. HICDC now wishes
to continue development of Phases 3 and 4 on the Property, which are now combined and referred
to as Phase 3-92 of the Project, in accordance with the requirements and allowances of the EO,
and is requesting those certain exemptions provided in Exhibit"A"attached hereto; and
Timing is critical as Hawaii Island Community Development Corporation intends to close financing in
late July or early August, which requires the Resolution with the updated density and zoning in place.

Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
