Subject: Bill 154 -Regarding Removal of Abandoned
Vehicles from Certain Private Roadways
Dear Ms. Poindexter and Hawaii County Council:

The Department of Environmental Management(DEM) is in support of Bill 154 regarding
the removal of abandoned vehicles from certain private roadways. Bill 154, as written,
would allow the DEM Derelict and Abandoned Vehicle (DAV)program to legally remove
abandoned vehicles from private roadways. DEM welcomes this modification.

Subject: Bill 154-Regarding Removal of Abandoned
Vehicles from Certain Private Roadways
Dear Ms. Poindexter:
Pursuant to the Hawai`i County Council's May 22,2018,referral of Bill 154 to the
Environmental Management Commission("EMC")for comment and recommendation,the
EMC met on June 27,2018,and discussed the bill.
By a unanimous vote at the meeting,the EMC hereby submits its approval and support of
Bill 154. In addition,the EMC recommends, in the proposed Section 20-38(c)(3) of the
bill regarding the promulgation of rules and procedures for the removal of abandoned
vehicles,that the rules the Department of Environmental Management promulgates contain
a component that educates the public on the procedures for reporting abandoned vehicles.
The EMC would also support any code changes that would allow the Department of
Environmental Management to issue citations for abandoned vehicles,in an effort to
expedite the removal process in order to keep all highways and roads open to public use
and as safe as possible.
