RE: Resolution No. 103-99, Draft 2
Please find attached proposed changes to Resolution No. 103-99. The proposed Draft 2
incorporates the new cost items for the UPW raises that have been transmitted to the Council by
Mayor Yamashiro.
The proposed Draft 2 also includes language that makes it clear that the cost items include the
excluded employees in Bargaining Unit 61. It also includes language that more accurately
describes changes to the original contract agreement via the "Memorandum of Agreement"
described at our last Council meeting when considering this Resolution. The last substantive
addition is a new Whereas statement that specifically states what the estimated settlement costs
to the County will be in Fiscal Year 1999-2000. The proposed Draft 2 also deletes four Whereas
statements which are misleading or not accurate.
Lastly, the proposed Draft 2 makes a few non-substantive changes to correct typographical and
punctuation errors in the original Resolution. For your convenience, I have also attached a
Ramseyer version of Draft 2 so that changes to the original Resolution can be more easily seen. [
have also attached a copy of the "Memorandum of Agreement" which is referred to in the
Resolution and which we discussed at the last meeting.

RAMSEYER FORMAT
A RESOLUTION APPROVING COLLECTIVE BARGAINING COST ITEMS FOR
THE INCLUDED EMPLOYEES OF THE COUNTY OF HAWAII IN BARGAINING
UNIT O1 (UNITED PUBLIC WORKERS), AND EMPLOYEES EXCLUDED FROM
THAT BARGAINING UNIT.
WHEREAS, Chapter 89, Hawaii Revised Statutes ("HRS"), establishes a
statewide collective bargaining process for public employees; and
WHEREAS, pursuant to Chapter 89, HRS, the Employers and representatives of
Bargaining Unit Ol (United Public Workers) met in late 1996 and early 1998 to negotiate
a collective bargaining agreement for the employees in the bargaining unit; and
WHEREAS, on March 10, 1998, the Employers and Bargaining Unit O1 reached a
tentative agreement, and a new contract was subsequently ratified by the Bargaining Unit
O1 membership; and
WHEREAS the Employers and Bargaining Unit O1 have agreed to new terms
and conditions to that contract via a Memorandum of Agreement dated Ma 3 1999• and
WHEREAS, the adjustments to wages and other non-wage cost items are part of a
collective bargaining agreement that is effective from July 1, 1995 through June 30,
1999; and
[WHEREAS, the 1998 State Legislature adjourned without appropriating funds
for collective bargaining costs for Bargaining Unit O 1; and
WHEREAS, the parties have subsequently agreed to the same terms and
conditions as previously ratified by the membership; and
WHEREAS, the 1999 State Legislature passed Senate Bill No. 1518 which
provides the counties funding for retroactive pay raises for Bargaining Unit O1; and]
WHEREAS, in fiscal year 1999-2000 the total estimated settlement costs to the
County of Hawaii, for the cost items established b the provisions of the new contract as
modified by the May 3 1999 Memorandum of Agreement will be $4 327 062• and
WHEREAS, pursuant to Section 89-10(b), HRS, the wage and non-wage cost items are
subject to appropriations by the respective legislative bodies[; and].
[WHEREAS, the cost items for the Mazch 10, 1998 agreement were approved by
the Maui County Council on August 7, 1998, by the Kauai County Council on
September 9, 1998, by the State Legislature during the 1999 Legislative Session, and by
the City and County of Honolulu on June 9, 1999; and]
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that it [approve] a roves the collective bargaining and related
cost items for the included employees of the County of Hawaii in Bargaining Unit O1,
and employees excluded from that bargaining unit, a summary of which is attached as
Exhibits 1(a), 1(b), and 2[; and].
BE IT FINALLY RESOLVED that copies of this Resolution be transmitted to the
Mayor, the Department of Civil Service, and the Department of Finance, County of
Hawaii.
