I read the proposed ordinance. As an owner of a Condominium unit within Alii Cove
Condominiums, I have concerns about the vague and or ambiguous (unscientific)
methods used to specify excessive noise as well as duration of exposure. My experience
with this type of vague language results in neighbors abusing their neighbors based on
personal choice of what is good vs. bad noise. With no measureable standard to enforce
the problem becomes a personal opinion or personnel vendetta. Here are my comments
and suggested changes to the ordinance.
Good neighbor policy. The owner or reachable person shall be responsible to
ensure that activities taking place within the short-term vacation rental conform to
the character of the existing neighborhood in which the rental is located.
At a minimum, the following shall be prominently displayed within the dwelling
unit and recited in the rental agreement signed by the tenant:
1) Quiet hours shall be from 9: 00 p.m. to 8: 00 a.m., during which time the noise
from the short-term vacation rental shall not unfencienably distwb adjaee
neighbe shall not exceed 55 dB, on an A weighted Scale, continuous noise greater than
45 minutes at the property line as measured using a calibrated ANSI Type II Sound Level
Meter.-
2) Sound that is audible beyond the property boundaries during non -quiet hours
shall not be more A na.ssive than would by ether -wise associate witL, n
residential area exceed 80 dB, on an A weighted scale, as measured using a calibrated
ANSI type II Sound Level Meter for continuous noise, not to exceed 6 hours. In addition
sound levels shall not exceed 90 dB on an A weighted scale, longer that 2 hours as
measured using a calibrated ANSI type II Sound Level Meter for continuous noise.
3) Amplified sound in excess of 80 dB. on an A weighted scale, as measured using a
calibrated ANSI type II Sound Level Meter for continuous noise, shall not to exceed 6
hours that is audible beyond the property boundaries between the hours of 8 a.m. and 9
p.m. of the nL e ft to fm do rental prohibited. Between the hours of 9 p.m. and 8
a.m. amplified sound shall not exceed 50 dB. on an A weighted scale, as measured using
a calibrated ANSI type II Sound Level Meter for continuous noise
