ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 25 (ZONING CODE) OF THE HAWAII
COUNTY CODE, AS AMENDED, RELATING TO ONE -ACRE PARCELS IN
AGRICULTURAL DISTRICTS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:

SECTION 1. Findings and purpose. The county council of the
County of Hawaii recognizes that the agricultural district
provides for agricultural and very low density residential use,
but at the same time recognizes that one -acre -agricultural parcels
are used primarily for residential uses. The
"Gentlemen/Gentlewomen farmers" with urban lifestyles use
agricultural dedication to minimize property taxes on their
country estates causing the price of agricultural land to increase.
The County General Plan states " The County of Hawaii shall
assist the expansion of the agricultural industry, especially
diversified agriculture, through the protection of important
agricultural lands, capital improvement and other programs, and
continued cooperation with appropriate State and Federal
agencies". To support this, the council believes that any
agricultural lot less than three -acres should be allowed only in
the county's RA and RS zoned district.

Therefore the purpose of this bill is to designate the minimum
building site area in any (A) agricultural district to three -acres.
SECTION 2. Section 25-154, Article 8, Chapter 25 of the
Hawaii County Code is amended as follows:
"Minimum building site area. The minimum building site area
to be designated for any A district shall be [one] three acres.
Other A districts having larger areas may be designated in
increments of [one] three acres up to a recommended maximum of ten
thousand acres."
SECTION 3. Section 25-155, Article 8, Chapter 25 of the
Hawaii County Code is amended as follows:
"Minimum building site average width. Each building site must
have a minimum average width of one hundred twenty feet for the
first [one] three acres of the required area plus twenty feet for
each additional acre of required area. The maximum required
average width for any building site shall be one thousand feet."
SECTION 4. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance,, the
brackets, bracketed materials, and underscoring need not be
included.
SECTION 5. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.

SECTION 6. This ordinance shall take effect upon its
approval.
