I wish to extend my sincere mahalo's for all your energies on this Bill. I've watched it from the •
time it was first introduced and it has gone through many-many revisions. That in itself
demonstrates that you are listening to your constituents and working to bring forth the best
bill for the good of our island people despite the mainland money interests. Concurrently you
have answered the plea of Mayor Kim that "something must be done".
The last two amendments from Ms Ohara and Ms Lee Loy were notably well intended and
gave more umph to the bill. Mahalo to you both for this additional clarification and
strengthening.
The language to require notification letters to all owners within 350 feet is excellent but for
agricultural zoned properties simply due to the larger lot sizes. Please consider increasing this
to perhaps 1000 feet to give those on ag lots equal opportunity as residential lots are given.
Further, please consider those neighbors affected (350' RS and 1000' AG) need to know who
to call (reachable person) when a problem exists. Consider that a weekend or very late/early
hour when a problem exists and a neighbor needs to call to communicate a grievance. If the
contact number is with the Department, no one is reachable outside normal business hours. If
an affected neighbor is successful in getting someone at the Department, will the reachable
person information be provided or is this some form of privacy which can't be given out to the
public? Is the only recourse at the time of a problem to call HPD? It would seem better for
neighbors to have the opportunity to work things out among themselves first given the ability
to do so.
When neighbors are not able to resolve issues with the owner and/or reachable person, what
is their alternative? Is there some grievance process to follow to get the Department to act?
Finally, I ask for your consideration to notice residents within the 350'/1000' affected area
whenever there is a petition for any non-conforming special use permit which would allow an
owner to have a short-term rental within RS and AG zones. We should have opportunity to
know and to present testimony to the non-conforming special use permit process as it may
affect the quality of our neighborhoods.
Mahalo nui for your support of Bill 108 for the safety, sanity and welfare of our residents and
for your consideration of these points I bring to your attention.
