Re: Mandatory Evacuation Order of May 31, 2018
Your Honor:
I and the majority of my neighbors in Leilani Estates subdivision whose homes are East
of Pomakai Street, (my home is at 13-3426 Kupano St.) have observed your Evacuation Order
for the last now almost three months with, needless to say, worry and concern over the impact
of the current order as looting has now become a major issue for many of us.
In consideration of the terms of the Evacuation Order, we are concerned with the
language of same, especially the portent that if we remain or return to the evacuation area we
are "...subject to arrest and liability for any recovery costs associated with rescue operations in
the ...area." We have reviewed the cautions of the County re questions frequently asked re
Home Owners Insurance coverage and we have notified our insurance agents re the
developments since May 3 issuance of Emergency Proclamations.
The purpose of this letter and our inquiry of Ms. O'Hara is to ask fora modification of
your Evacuation Order to allow those of us whose homes have not been damaged by the
flow(s)over the last three months to allow us to return to our properties to secure same from
looters as best wecan and to allow us to resume residency with the understanding that we
would do so at our own risk with knowledge that emergency/first responders may not respond
in the event of change to the areas affected. In re our home owner's insurance coverage we
have notified our carrier and note that inour policy we are covered for loss by fire, wind etc
risks of loss. We have also noted that our policy(s) also require us to mitigate potential loss in
several ways, all of which require us to have access to the property.
With the foregoing in mind, please consider our request asap re a modification of the
Order to at least move the demarcation line in the area further east so as to allow us the same
rights of access as those whose properties lie to the West of the demarcation line.
