Young, Jr. and the entering into an intergovernmental agreement Pursuant to Section 6-5.5 of the Hawai`i County Charter(2014), the Office of the Corporation Counsel respectfully requests the Council place the above matter on its agenda for the purpose of hiring special counsel to assist our office with this case. We are also requesting to be put on the agenda, the ability to enter into an intergovernmental agreement pursuant to Hawai`i Revised Statutes § 46-7. Time is of the essence since the Ninth Circuit Court of Appeals issued its decision on July 24, 2018 and the deadline to file a petition for en bane hearing is currently September 14, 2018.' The preparation of the petition for an en bane hearing will require substantial time and effort and therefore, it is important to retain special counsel as soon as possible. We kindly ask that this case be placed on the September 5, 2018 council agenda. We also kindly ask that this request be waived through committee due to our short deadlines.
