Your Committee on Planning, to which was referred Bill No. 178,reports as follows:
Bill No. 178, transmitted by Managing Director Wil Okabe, via Communication No. 1025, dated
August 1, 2018, amends Ordinance No. 07-166, which reclassified lands from Agricultural—one
acre(A-la)to Multiple Family Residential— 5,500 square feet (RM-5.5) at Waiakea, South Hilo,
Hawai`i, covered by Tax Map Key: 2-3-037:015 (Applicant: Michelle A. Mitchell (formerly
Malulani, Inc.) (Area: approximately 1.278 Acres).
Managing Director Wil Okabe forwarded the Windward Planning Commission's favorable
recommendation for this amendment to request an additional five-year time extension to
complete construction of a medical clinic on the property. The property is located on Ponahawai
Street, approximately 650 feet east of its intersection with Komohana Street.
Project Manager Merrick Patten appeared for the applicant and Jeff Darrow from the Planning
Department was present to answer questions.
Jeff Darrow, in response to inquiry by Council Member Aaron Chung, said that the original
owner and applicant applied for multiple family zoning to create apartment buildings, then sold
the property to Michelle Mitchell for a medical building. He stated that in regard to the overall
zoning in the General Plan, it is Medium Density Urban which allows commercial neighborhood
and multiple family uses. Mr. Darrow further explained that the applicant felt that going through
the use permit process was sufficient, and that it went through the required a public hearing.
The vote was then taken on the motion to move this measure to Council with a positive
recommendation and passed with seven "ayes."

Your Committee on Planning is in accord with the purpose and intent of Bill No. 178, and
recommends its passage on first reading.
