This recommendation was based on project's non- compliance with the"concurrency"provision of the Kona Community Development Plan ("KCDP"). To date, no action has been taken by the County Council on this matter. The applicant understands that proposed amendments to the KCDP are being contemplated,which, if approved,could address and/or overcome the reasons for the unfavorable recommendation. However,that could take time. Further, over the past seven(7) years,the applicant's plans for the property have been modified. As such, I have been instructed by the applicant, 327 Kona,LLC,to withdraw the subject rezoning application. Should the KCDP be amended in a manner that makes further development of the subject property possible,the applicant will submit an application consistent with the amended KCDP. We would appreciate your taking appropriate action to inform the County Council of this decision so that the application can be effectively considered withdrawn.
