AN ORDINANCE AMENDING THE STATE LAND USE BOUNDARIES MAPS FOR THE COUNTY OF HAWAII BY CHANGING THE DISTRICT CLASSIFICATION FROM THE AGRICULTURAL DISTRICT TO THE URBAN DISTRICT AT WAIAKEA, SOUTH HILO, HAWAII (TAX MAP KEY: 2-4-001:177, 185, AND 186). BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The State Land Use Boundaries Maps for the County of Hawai`i are amended to change the district classification of property described hereinafter as follows: The district classification of the following area situated at Waiakea, South Hilo, Hawai`i, shall be Urban: LOT 3-A: Beginning at the northeast corner of this parcel of land, being also the northwest corner of Lot 3-B, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALAI"being 4,046.34 feet SOUTH and 492.50 feet EAST running by azimuths measured clockwise from true South: 1. 343° 50' 551.54 feet along Lot 3-B, Waiakea Cane Lots; 2. 239° 54' 08" 23.78 feet along the same; 3. 329° 54' 08" 59.62 feet along the same; Thence, along the north side of Mohouli Street, on a curve to the right with a radius of 1,930.00 feet, the chord azimuth and distance being; 4. 65° 31' 34" 378.27 feet; 5. 341° 09' 20.00 feet along a jog on the north side of Mohouli Street; Thence, along the same, on a curve to the right with a radius of 1,950.00 feet, the chord azimuth and distance being; 6. 71° 40' 15.5" 35.46 feet; Thence, along Road Lot (Parcel 178), on a curve to the right with a radius of 30.00 feet, the chord azimuth and distance being; 7. 118° 00' 45.5" 43.03 feet; 8. 163° 50' 269.21 feet along the same; 9. 73° 50' 50.00 feet along the same; 10. 163° 50' 373.97 feet along Lot 2, Waiakea Cane Lots; 11. 253° 59' 52" 424.66 feet along the Lot 347 and Lot 346 as shown on Map 75, Land Court Application 1205; 12. 238° 14' 28.62 feet along Lot 383 as shown on Map 81, Land Court Application 1205 to the point of beginning and containing an area of 6.376 acres, more or less. LOT 3-B1-A: Beginning at the northwest corner of this parcel of land, being also the northeast corner of Lot 3-A and on the southerly boundary of Lot 383, Land Court Application 1205, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALAI", being 4,046.34 feet South and 492.50 feet East, thence running by azimuths measured clockwise from true South: 1. 238° 14' 224.32 feet along Land Court Application 1205 (Lot 383, Kahikini Street and Lot 86); -2- 2. 343° 50' 299.36 feet along the remainder of Government Land of Waiakea (Lot 3-B 1-B); 3. 73° 50' 58.58 feet along the remainder of Government Land of Waiakea (Lot 3-B2); 4. 343° 50' 22.77 feet along same; 5. 73° 50' 157.48 feet along same; 6. 163° 50' 261.81 feet along the remainder of Government Land of Waiakea (Lot 3-A) to the point of beginning and containing an area of 1.418 acres. LOT 3-B2: Beginning at the southeast corner of this parcel of land,being the southwest corner of Lot 3-B1 and on the northwesterly side of Mohouli Street, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALAI", being 4,506.34 feet South and 864.92 feet East, thence running by azimuths measured clockwise from true South: 1. 58° 10' 142.31 feet along Mohouli Street; 2. 328° 10' 5.00 feet along Mohouli Street; 3. 59° 02' 08" 58.45 . feet along Mohouli Street; 4. 149° 54' 08" 59.62 feet along the remainder of the Government Land of Waiakea (Lot 3-A); 5. 59° 54' 08" 23.78 feet along same; 6. 163° 50' 289.73 feet along same; 7. 253° 50' 157.48 feet along the reminder of the Government Land of Waiakea(Lot 3-B1); 8. 163° 50' 22.77 feet along same; 9. 253° 50' 58.58 feet along same; -3- 10. 343° 50' 237.67 feet along same; 11. 332° 41' 70.12 feet along same to the point of beginning and containing an area of 1.585 Acres. All as shown on the map attached hereto, marked Exhibit "A" and by reference made a part hereof. SECTION 2. This change in district classification is conditioned upon the following: A. The applicant, successors, or assigns shall notify prospective purchasers, tenants, or lessees of all lots that fanning operations and practices on adjacent or contiguous land in the State Land Use Agricultural District are protected under Hawai`i Revised Statutes Chapter 165, the Hawai`i Right to Fann Act. This notice shall be included in any disclosure required for the sale or transfer of all of the proposed lots. B. Any action that would interfere with or restrain fanning operations on adjacent or contiguous properties shall be prohibited under Hawai`i Revised Statutes Chapter 165, the Hawai`i Right to Farm Act; provided the farming operations are conducted in a manner consistent with generally accepted agricultural and management practices on adjacent or contiguous lands in the Agricultural District. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. -4- SECTION 4.
