RESOLUTION NO. 724 1-8
A RESOLUTION TRANSFERRING/APPROPRIATING AN APPROPRIATION OUT
AND FROM A DESIGNATED FUND ACCOUNT AND CREDITING SAME TO A
DESIGNATED FUND ACCOUNT TO PROVIDE A GRANT TO THE WAIMEA
PRESERVATION ASSOCIATION FOR TRANSPORTATION EXPENSES RELATING
TO THE RESCUE FOOD PROGRAM IN WAIMEA.
WHEREAS, the Waimea Preservation Association is a 501(c)(3) nonprofit organization
that serves the community by preserving the character, culture, and history of Waimea; and
WHEREAS, the Rescue Food Program is a group of volunteers dedicated to providing
free, quality prepared food to those in need to create a healthier and safer community in Waimea;
and
WHEREAS, the Rescue Food Program collects quality donated food that would
otherwise be disposed of by stores and restaurants, and this program is backed by the federal Bill
Emerson Good Samaritan Food Donation Act of 1996 and the Hawaii Good Samaritan
Donation of Food Act (Chapter 145D, Hawaii Revised Statutes), which protects the donor and
the distributing organization from liability; and
WHEREAS, the Waimea Preservation Association is committed to working with the
Rescue Food Program in its efforts to share resources, improve the quality of life, and influence
the future and character of Waimea through this needed program; and
WHEREAS, the Waimea Preservation Association is requesting funds for transportation
expenses to continue the efforts of the Rescue Food Program; and
WHEREAS, the Department of Liquor Control supports organizations and alcohol -free
and drug-free programs that focus on the health and wellness of the community; and
WHEREAS, pursuant to Section 2-139(a)(2)(A) of the Hawaii County Code,
Contingency Relief funds shall be transferred to an accepting County department/agency via
resolution identifying the nonprofit organization and the specific program, project, event, activity,
service, equipment, materials, or supplies for which the grant shall be used; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
Contingency Relief funds from Council District 9 will be appropriated to the Department of
Liquor Control to provide a grant to the Waimea Preservation Association for transportation
expenses relating to the Rescue Food Program in Waimea.
BE IT FURTHER RESOLVED that the Council of the County of Hawaii hereby
transfers/appropriates the following amount as set forth below:

BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Director of Liquor Control and Director of Finance, and that the Director of
Finance is hereby authorized to make the necessary transfers in accordance with the terms of this
resolution.
