RE: Request to Have Proposed General Plan Amendment Added to Agenda of
Next Hawaii County Planning Committee Meeting
Dear Councilman Tyler:
Congratulations on your recent election to the office of Councilman for the North Kona
district. We are all looking forward to the changes you will bring to our community.
As you are aware, I previously attempted to have the Hawaii County Planning Director
initiate my proposed amendments to the General Plan. She has refused. Although a
direct Third Circuit Court challenge is possible, I would prefer to use a more
constructive approach in having this GPA considered.
According to Section 6.6(3) of Ordinance 89-142, the Hawaii County General Pfan, the
Council may initiate proposed amendments to the General Plan, according to the
procedure detailed therein. The first step in that procedure is for the Council to adopt,
by two-thirds of its entire membership, a resolution concerning the GPA.
Therefore, in order to have my GPA considered for such a resolution, I respectfully
request that my amendments be scheduled for discussion by the Hawaii County
Planning Committee at its next meeting. The proposed amendments are attached to
khis letter.
I also request that this letter, and its exhibit, be a numbered communication.

Proposed Amendments to the Hawaii County General Plan
1. Amend the General Plan LUPAG map to redesignate the entire land divisions of
Onouli and Keopuka, makai of the Mamalahoa Highway, from "Open Area" and
"Extensive Agriculture" to "Conservation".
2. Amend the General Plan, Section 4, "Goals, Policies and Standards", section M (8),
"Land Use, Public Lands", as follows:
STANDARD
Any public right-of--way protected as a State public trail by Hawaii
Revised Statutes (HRS) Chapter 264 shall be further protected by a 2t)0-
foot wide buffer zone for the entire length of the trail. The land use
designation for the treil and fhe buffer zone shall be Conservatian.
