Thank you for your service to the County of Hawaii and its citizens. I understand all of you
are working diligently to balance competing interests and opposing views with regard to ter~
House Bill 108. >rn
On behalf of the island's many condominium owners offering their homes as vacation OD
rentals, I would like to thank you for the compromise you have struck in this latest writing of
House Bill 108. Your decision to include the "RM district for multiple family dwellings within
a condominium property regime" both preserves what I believe is the original intent of the
Bill—to protect single-family residential and agricultural communities from the adverse
effects of short-term rentals—while still allowing vacation rentals to exist in the
condominium communities that have chosen to allow such activities.
My family has operated a vacation rental in Kona Pacific Condominiums for many years.
We are properly registered with the State; have on-island representation available 24/7; pay
all Transient Accommodation Taxes; provide each guest with a copy of our condominium
House Rules; and ensure that each and every one of our guests conform to those rules.
While the previous writing of House Bill 108 may have allowed us (and the other 20+
vacation rentals in our complex) to be allowed to continue our vacation rental activities
through a non-conforming use permit, it seemed unfair that our neighbors (who do not
currently engage in short-term rentals) would be banned from doing so in the future. I
believe the County was correct in leaving the decision whether a condominium allows
short-term rentals (or not) to its owners and their homeowners association.
I sincerely appreciate the Council's willingness to hear the concerns of its constituents on
this matter, and I wholly support the bill in its current version, as it does in fact seem to
strike a fair balance.
