Resolution No. 462
RESOLUTION RELATING TO "IMPROVEMENT DISTRICT NO. 11 - DISCOVERY HARBOR SUBDIVI-
SION AND ADJACENT LANDS," IN WAIOHINU, DISTRICT OF KAFU, HAWAII, CONDITIONALLY
ACCEPTING A BID FOR WORK TO BE PERFORMED IN AND FOR SAID IMPROVEMENT DISTRICT.
WHEREAS, due advertisement for bids upon proposal for the streets,
street lighting and on-site water facilities in and for ^Improvemert District
No. 11 - Discovery Harbor Subdivision and Adjacent Lands,' Waiohinu, District
of Kalu, Hawaii, having been had, and the time for receiving tenders therefor
having expires at 2 o'clock p.m., January 25, 1972; and
WHEREAS, competitive bids for the improvements have been received
and were duly opened after the expiration of the call as aforesaid; and
WHEREAS, at the close of bidding as aforesaid, the following bids
for the improvement were received and opened by the Chief Engineer and submitted
to the County Council by the Chief Engineer of the Department of Public Works,
to wit:

*Allowance for utility pole installation in accordance with the Revised
Estimated cost of improvement dated February 7, 1972.
Time of Completion: Four Hundred (400) calendar days after official notification
from Chief Engineer to proceed with construction; and
WHEREAS, the lowest bidder for the improvements is Morrison-Knudsen Co.,
Inc., which has offered to furnish and pay for all material, including tools,
equipment and labor, necessary to construct and fully complete the streets, street
lighting and on-site water facilities in and for "Improvement District No. 11 -
Discovery Harbor Subdivision and Adjacent Lands,^ Waiohinu, District of Kalu,
Hawaii, for the total sum of TWO MILLION SIX HUNDRED THOUSAND NINETY-SIX AND
NO1IO0 DOLLARS ($2,600,096.00)g and
WHEREAS, after due consideration by this Council, it is deemed advisable
to accept this tender on the basis of the terms set forth in its approval for the
improvements, as set forth in the form duly advertised and agreed to by said bidder,
and waiving all defects,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COUNCIL in and for the
County of Hawaii;
I.
That the proposal for said improvements, as submitted by Morrison-
Knudsen Co., Inc., to furnish and pay for all material, including tools, equipment
and labor, necessary to construct and fully to complete the streets, street lighting,
and on-site water facilities in and for ^Improvement District No. 11 - Discovery
Harbor Subdivision and Adjacent Lands,' Waiohinu, District of Kale, Hawaii, as
set forth in the specifications attached to said proposal be and the same is hereby
accepted by this Council, contingent upon the further progress of the proceedings
relating to said ttImprovement District No. 11 - Discovery Harbor Subdivision and
Adjacent Lands,'t in Waiohinu, District of Katu, Hawaii, to a final award of the
contract for said work in due course under the provisions of the improvement
district ordinance, No. 350, as amended, County of Hawaii, and upon the understanding
that upon notice of the final award by this Council, said bidder will execute a
contract for the work and furnish bond as required by law and said specifications.
II.
That the Chief Engineer of the Department of Public Works shall hereafter
be authorized and directed to issue a call for tenders upon the off-site water
facilities to be constructed for said improvement district at such time as the
final details, plans and specifications therefor have been completed and approved
by the Department of Water Supply and this Council,, as heretofore provided in
these proceedings.
RESOLUTION NO. 462
That the County Clerk is hereby authorized and directed to notify
said bidder of the action herein taken and of the conditional acceptance of
its bid on its proposal for said improvements according to the terms thereof.
