HomeMy WebLinkAboutRES 464 Draft 01 1969-1972County of Hawaii—State of Hawaii Resolution No. 464 RESOLUTION APPOINTING ENGINEERING CONSULTANT AND LEGAL AND BOND COUNSEL CONSULTANTS - IMPROVEh1ENT DISTRICT NO. 11, DISCOVERY HARBOR SUBDIVISION AND ADJACENT LANDS, WAIOHINU, DISTRICT OF KA'U, COUNTY OF HAWAII, HAWAII WHEREAS, this Council has determined to undertake proceedings pursuant to Ordinance No. 350 of the County of Hawaii, an Ordinance for Improvement by Assessment, for the construction of special improvements in said Improvement District No. 11 - Discovery Harbor Subdivision and Adjacent Lands; WHEREAS, the public interest will be served by appointing and employing engineering and legal consultants in connection with the preparation and conduct of said proceedings and the construction of said improvements; NOW, THEREFORE, BE IT RESOLVED by the County Council of the County of Hawaii as follows: 1. That J.H.K. Tanaka, Inc., Hilo, Hawaii, be, and it is hereby, appointed as an engineering consultant and employed to do and perform all engineering work necessary in and for said proceedings, including all surveying, preparation of reports, plans, profiles, specifications, estimates of costs, and assessments, setting grade stakes and supervision of work; that its compensation shall be as set forth in that certain letter agreement from it to this Council, dated January 27, 1972, subject to the sale of the bonds, which letter agreement is hereby approved and accepted; and that said compensation has been included in the costs of the improvement district and shall be assessed as an incidental expense of said proceedings. 2. That the Chief Engineer, Department of Public Works, of said County is hereby directed to examine and approve the engineering documents, and to provide inspection of the construction of said improvements and to accept said work when done to his satisfaction; and that the cost of said inspection shall be assessed as an incidental expense of said proceedings. 3. That the law firms of Izumi & Tanaka, Honolulu, Hawaii, and Wilson, Jones, Morton & Lynch, San Mateo, California, be, and they arc hereby, appointed as leeal and bond counsel consultants and employed to do and perform all leqal services required in the conduct of said proceedings; that their compensation shall be as set forth in that certain letter agreement from them to this Council, dated November 9, 1971, subject to the sale of the bonds, which letter agreement is hereby approved and accepted, and that said compensa- tion has been included in the costs of the improvement district and shall be assessed as an incidental expense of said proceedings. 4. That the fees provided to be paid herein be paid from the proceeds of said assessments to be levied and bonds to be issued, and not otherwise.
