Resolution No. 179
RESOLUTION RELATING TO THE PROPOSED KAUILA STREET SEWERS, IMPROVEMENT
DISTRICT IN THE PUUEO DISTRICT, SOUTH HILO, HAWAII, PROPOSED UNDER
RESOLUTION No. 413 of 1971, ADOPTING THE PRELIMINARY REPORT OF THE
CHIEF ENGINEER DATED MARCH 1, 1972 AND PROVIDING FOR A PUBLIC HEARING.
WHEREAS, by Resolution No. 413, adopted by the County Council of
the County of Hawaii on the 20th day of October, 1971, the Chief Engineer
of the Department of Public Works was ordered and directed to investigate
and report to said County Council preliminary data for the construction
of sanitary sewers for the KAUILA STREET SEWERS, IMPROVEMENT DISTRICT, in
the District of South Hilo, County and State of Hawaii, in accordance with
the provisions of Section 3.1, Ordinance 350, as amended, and in accordance
therewith said Chief Engineer has prepared and submitted to this Council a
report thereon, dated March 1, 1972, and filed with the Clerk of the County
of Hawaii on the 6th day of March, 1972, showing the necessary preliminary
surveys, maps, plans, drawings, and other data, details and specifications
for the proposed improvements, together with detailed estimates of the
probable cost thereof, and showing a description and the maximum unit of
improvements per square foot against the property subject to assessment
therefor, in all respects in the manner, form and detail as required by law,
and as directed in said Resolution No. 413; and
WHEREAS, said plans for said improvements so proposed in and by said
Resolution No. 413, and described in said Chief Engineerls Preliminary Report
thereon, have now been further and fully considered by this Council, and in
the opinion of this Council, said improvements are desirable and should be
made{
NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii
as follows:

That the plans and description, details and preliminary specifications
for said proposed construction of Kauila Street Sewers aforesaid, so prepared
and presented to this Council by said Chief Engineer and described in
his said reports thereon now on file as aforesaid, be and the same are
hereby approved and adopted as and for the preliminary surveys, maps,
plans, drawings, details, and specifications for said proposed improve-
ments, subject to such alterations and amendments as shall hereafter be
adopted according to law; all of which are hereby incorporated and made
a part of this resolution.
That the proposed improvement district will incorporate all of the
lots not sewered within the boundaries as shown on the map accompanying
the Chief Engineer's report.
That it is proposed to install 61T and 8TI pipes together with all
YTS, manholes, and appurtenances, in place complete.

That it is proposed to pay for the sewer improvement by assessments
made on the area basis, permitting the owner to pay all of said assessments
in one (1) payment or in twenty (20) equal annual installments of principal
with interest on deferred payments at the rate of eight percent (8%) per
annum.
That the proposed assessment shall be $0.06 per square foot for
agricultural, parks and recreation, preservation, public facilities and
utilities, military and cemetery general planned areas; $0.08 per square
foot for residential; $0.10 per square foot for commercial and industrial
general planned areas; and $0.12 per square foot for hotel, apartment,
resort -hotel and public housing general planned areas.

That the area to be improved lies within the boundaries as shown on
Exhibit I of the Chief Engineer's Preliminary Report, with an assessable
area of approximately 159,000 square feet.

That a public hearing be had respecting the said proposed improve-
ments before the Council of the County of Hawaii, at its Council Room
on the 18th day of April , 1972, at the hour
of 7:30 o'clock P . M., or as soon thereafter as those interested
may be heard.

That the Clerk shall give notice on behalf of the Council, as
required by law, to the owners, lessees, and occupants of the lands
fronting or abutting Kauila Street proposed to be assessed, and to all
persons interested generally, of the general character and extent of
the improvements proposed, the materials proposed to be used, the proposed
method of assessment, of the area to be assessed, the probable cost of
said improvements, the part or proportion of cost proposed to be borne
by the County of Hawaii and the maximum unit cost per square foot for
said improvements, all according to said plans and specifications, details
and estimates as submitted and filed by said Chief Engineer; together
also with notice that the map and general plans, details, specifications,
estimates and other data so prepared by said Chief Engineer with respect
to the proposed improvements, and herein approved by this Council, for
the making of said proposed improvements, may be seen and examined by any
person interested at the Department of Public Works at any time during
business hours prior to the date fixed and advertised for said public hear-
ing thereon; give notice of the time and place of said public hearing
respecting the proposed improvements, and that a full opportunity will then
be given to all persons interested to present suggestions or objections to
the proposed improvements or to any part or detail thereof; and further
post similar notices conspicously at least ten (10) days prior to the hear-
ing approximately every two hundred and fifty (250) feet along the street

proposed to be improved; said notice to be given and published in the
Lam and manner required by Section 3.1, Ordinance 350, as amended.
