RESOLUTION CREATING, DEFINING AND ESTABLISHING "IMPROVEMENT
DISTRICT NUMBER 10, KALOKO MAUKA SUBDIVISION, KALOKO, NORTH KONA, HAWAII,
AND PROVIDING FOR THE IMPROVEMENT THEREOF.
WHEREAS, by Petition (Comm. No. 1602), dated September 14, 1971,
and filed with the County Clerk on September 14. 1971, the owners of more
than sixty percent (6(%) of the entire area within the proposed improve-
ment district for Kaloko Mauka Subdivision, Kaloko, North Kona, County
and State of Hawaii, asked for certain permanent improvements in said
district, in accordance with the provisions of Section 3.3 of Ordinance
No. 350, as amended, of the County of Hawaii.
WHEREAS, by Resolution No. 412, adopted October 20, 1971, the
County Council directed the Chief Engineer of the Department of Public
Works to investigate and report to the County Council the preliminary data
concerning the necessity, feasibility and method desirable for the improve-
ments consisting of a road system, a local water system and a street light-
ing system for the aforementioned proposed improvement district, and to
include in his preliminary report all such data, survey maps, plans, draw-
ings, detail specifications, further improvements and any other matters or
details intended to apply thereto in accordance with the provisions of
Section 3.1 of Ordinance No. 35. as amended; and
WHEREAS, said Engineer has caused to be prepared and submitted to
this Council a report thereon, prepared by Boyle Engineering, dated November
4, 1971, and filed with the Clerk of the County of Hawaii on November 5, 1971,
showing the necessary preliminary surveys, maps, plans, drawings, descriptions
of property to be acquired and other data, details and specifications for the
proposed improvements, together with detailed estimates of the probable cost
thereof, and showing a description and an estimate of the shares of the costs
of improvements per square foot against the property subject to assessment
therefor, in all respects and in the manner, form and detail as required
by law; and as directed in said Resolution No. 412; and
WHEREAS, by Resolution No. 424, adopted November 17, 1971, said
preliminary report was duly adopted by this Council, subject to such
alterations and amendments as should thereafter be made and adopted accord-
ing to Law, and a public hearing with respect to said proposed improvements
was provided to be held on January 17, 1972, at the hour of 7:30 o'clock
p.m., or as soon thereafter at Hale Halawai, Kailua-Kona, Hawaii, as those
interested could be heard; and
WHEREAS, after notice was duly given by publication commencing
December 26, 1971, in the Hawaii Tribune Herald and by posting of like
notices along the roads proposed to be improved or opened on January 5,
1972, a public hearing was duly held on January 17, 1972, at Hale Halawai
in Kailua-Kona, Hawaii, at which public hearing a quorum of said Council
was present and full opportunity was given then and there to all persons
interested to present objections or suggestions with respect to the proposed
improvements or any part or detail thereof; and
WHEREAS, at said public hearing, no protests were filed against
the making of the proposed improvements or any part of the plan thereof;
and
WHEREAS, after full hearing had thereon, said public hearing was
closed and the matter taken under advisement; and
WHEREAS, this Council having now and fully considered all and singularly
the plans for said improvements and all objections, petitions and suggestions
presented or offered with respect thereto, did find and declare that the
Council still had jurisdiction thereof and has now determined to proceed with
the proposed improvements substantially as set forth in said Chief Engineer's
preliminary report without materially altering the general character or plan
thereof as so advertised and without increasing the maximum estimate of cost
per square foot;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
AS FOLLOWS:

IMPROVEMENT DISTRICT CREATED
That the proposed Kaloko Menke Subdivision, Improvement District,
Kaloko, North Kona, State of Hawaii, is hereby created, defined and
established as "IMPROVEMENT DISTRICT NUMBER 10, KALOKO MAUKA SUBDIVISION,
KALOKO, NORTH KONA, COUNTY AND STATE OF HAWAII,^ the limits and extent of
which, and the areas to be assessed, as shown on the Map, Exhibit II of
the Preliminary Report on file in the office of the County Clerk, being
hereby more particularly created, defined and established in Exhibit I -A
of the Preliminary Report and attached hereto.
The Improvement District Boundaries for IfIMPROVEMENT DISTRICT
NUMBER 10, KALOKO MAUKA SUBDIVISION, KALOKO, NORTH KONA, COUNTY AND STATE
OF HAWAII, and for Zones 1, 2 and 3, thereof as shown on the Map Exhibit
II of the Preliminary Report on file in the Office of the County Clerk,
is described in the descriptions Exhibits I -B, I -C and I -D, of the prelimi-
nary Report attached hereto.
CHARACTER, EXTENT AND GENERAL DETAILS
AND MATERIALS OF IMPROVEMENT DEFINED
1. That the general character, extent and materials, of the
proposed improvements for which detailed specifications shall hereafter
be adopted shall be and are hereby defined and described as follows:
A. GRADING:
All streets shall he graded a minimum of 34 feet in width and
to approved lines and grades.
B. PAVEMENT:
The pavement shall consist of a two-inch thick asphaltic concrete
surfacing twenty (201) feet wide on a crusher run base course of not less
than four (411) inches thick and a subbase course of not less than six (611)
inches thick.
C. ROAD SHOULDERS:
Along both sides of the road pavement a minimum of eight (81) feet
wide road shoulder of subbase shall be placed and rolled and shall conform

to the established grades and Lines.
D. DRAINAGE:
Drainage facilities shall be by ditch section as a part of the
road prism. Culverts shall be provided where needed for cross drainage.
E. STREET LIGHTING SYSTEM:
A street lighting system, shall be installed with lights mounted
on metal standards or utility poles, including lamps, luminaires, conduits,
and other appurtenances incidental thereto. Street lights shall be provided
at all intersections, at the beginning of curves, and at the end of all
dead end streets.
F. LOCAL WATER SYSTEM:
Water pumping stations, reservoirs, and water mains consisting of
four -inch, six-inch, and eight -inch Ductile Iron Pipe, including valves,
fittings, service laterals, and appurtenances shall be installed in accor-
dance with the requirements of the Board of Water Supply.
2. That the general details of the proposed improvements shall
be substantially as set forth in said Chief Engineerts Preliminary Report
and the Map and other exhibits accompanying the same (herein incorporated
by reference), as by this Resolution may be altered, or modified, providing
that such minor alterations and changes in work or materials may be made
in the details of any part or parts of said improvements as shall, in the
judgment of the Chief Engineer of the Department of Public Works seem
necessary or advisable to complete the same in an efficient and satisfac-
tory manner and without materially altering the general character or plan
of said improvements and otherwise consistent with the terms of this Resolu-
tion and subject always to the approval of this Council.

The descriptions of lands to be acquired for street right-of-way,
waterline right-of-way and water system facilities within the created
improvement district and off site improvements, as shown on the Parcel Map,

AREAS TO BE ASSESSED AND
METHODS AND ESTIMATED RATES OF ASSESSMENTS
1. That by the aforementioned Petition (Comm. 1602) and Resolution
No. 424, the entire cost of the improvements within Improvement District
Number 10, Kaloko Macke Subdivision, Kaloko, North Kona, Hawaii, including
the cost of any land and damages required for street right of way and
easements, the cost of engineering, inspection and incidentals, and all
general expense not otherwise provided shall be assessed against the benefited
properties within the proposed Improvement District on an area basis.
2. That within the proposed Improvement District there shall be
established three zones of benefit, the lands within each such zone to be
assessed upon the basis of the benefit to be received.
3. That the assessments shall be payable in one (1) payment or in
twenty (20) equal annual installments of principal and interest at a rate
not exceeding eight per cent (8%) per annum.

PORTION OF COST TO BE BORNE
BY THE COUNTY OF HAWAII
That by the provisions of Article IV above, there shall be no cost
to be borne by the County of Hawaii for the general improvements, water system,
land acquisition, cost of engineering, inspection and incidentals and all
general expenses not otherwise provided.

FINAL PLANS AND SPECIFICATIONS OF WATER SYSTEM
That the Department of Water Supply is hereby requested to
furnish final detailed plans and specifications for the water system
in said Improvement District which shall be used as the basis for the
calling for bids for the work. That the Chief Engineer of the Depart-
ment of Public Works, is hereby requested to furnish the Department of
Water Supply with such copies of the final surveys, maps and plans
covering the proposed improvements, other than for the water system,
as may be necessary to enable the Department of Water Supply to prepare
the final plans and specifications for the water system.

FINAL REPORT OF ENGINEER
That the Chief Engineer of the Department of Public Works,
is hereby requested and directed to determine and specify with particu-
larity all of the matters and things requisite or proper for the full
performance and completion of the work in accordance with the terms and
intent of this Resolution and to prepare a map of said Improvement
District, showing the streets to be improved and the separate parcels
of land abutting thereon with the areas thereof, and showing the exact
location of all improvements, together with final plans, drawings, details
and specifications for the entire work; all in such form as will readily
permit and encourage genuine competition between contractors insofar as
the materials specified will permit of such competition, and in such
form that the same may be used as the basis of calling for bids for the

entire work under one or more contracts, and further to submit the
same to this Council for its approval.
