PROVIDING FOR THE ACQUISITION OF LAND FOR A PUBLIC PARK, PAHOEHOE 3rd AND
4th, NORTH KONA, DISTRICT OF NORTH. KONA, COUNTY AND STATE OF HAWAII.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
I.
That it is necessary, for the public use and purpose, to wit: Public
park and recreation purposes in North Kona, District of North Kona, County
and State of Hawaii, to take, acquire, and condemn certain land with all
improvements thereon and appurtenances thereunto belonging, in fee simple
absolute, free and clear of all liens and encumbrances, hereinafter described
and to that end and for these purposes the Corporation Counsel of the County
of Hawaii be and he is hereby authorized and empowered to initiate proceedings
in eminent domain, as provided by law, for the taking, acquisition and condemna-
tion of Parcels 17, 35, 93 and 94 of Tax Map Key 7-7-08, and more particularly
described as follows:
All of that certain parcel of land situate at Pahoehoe 3rd and
4th, North Kona, District of North Kona, Island and County of Hawaii,
State of Hawaii.
Lot 2-A, area 12,605 square feet; Lot 2-B, area 3,454 square feet;
Lot 1-B, area 109 square feet, and Lot 1-A, area 2,949 square feet,
as shown on Map 1, filed in the Office of the Assistant Registrar
of the Land Court of the State of Hawaii with Land Court Application
1781 (amended) ;
Being all of the Land described in Transfer Certificates of Title
numbered 139,776; 140,874; and 141,082.
II.
That in the process of said proceedings in eminent domain, said Corpora-
tion Counsel be and he is hereby authorized and empowered to negotiate terms
of settlement, subject of the approval of this Council and of the Court
before which such proceedings are prosecuted.
