Resolution No. 544
RESOLUTION RELATING TO "IMPROVEMENT DISTRICT NO. 10 - GENERAL IMPROVEMENTS
FOR KALOKO MAUKA SUBDIVISION", IN THE DISTRICT OF NORTH KONA, COUNTY OF
HAWAII, CONDITIONALLY ACCEPTING A BID FOR THE WORK TO BE THEREIN PERFORMED
AND DIRECTING THE CHIEF ENGINEER OF THE DEPARTMENT OF PUBLIC WORKS TO PREPARE
A CORRECTED MAP AND PRELIMINARY ASSESSMENT ROLL.
WHEREAS, due advertisement for bids upon proposal for the general improve-
ments in "Improvement District No. 10 - General Improvements for Kaloko Mauka
Subdivision", North Kona, Hawaii (Job No. P-1821), having been had, and the
time for receiving tenders therefor having expired at 2 o'clock p.m., June 22,
1972; and
WHEREAS, competitive bids for the improvements have been received and were
duly opened after the expiration of the call as aforesaid; and
WHEREAS, at the close of bidding as aforesaid, the following bids for
the improvement were received and opened by the Chief Engineer and submitted
to the County Council by the Chief Engineer of the Department of Public Works,
to wit:

Time of Completion: Four Hundred Fifty (450) consecutive calendar days after
official notification from Chief Engineer to proceed with
construction; and
WHEREAS, the lowest bidder for the improvements is J. M. Tanaka Construc-
tion, Inc., which has offered to furnish and pay for all material, including
tools, equipment and labor, necessary to construct and fully complete the
entire general improvements in "Improvement District No. 10 - General Improve-
ments for Kaloko Mauka Subdivision", North Kona, Hawaii, for the total sum of
THREE MILLION FOUR HUNDRED FORTY-EIGHT THOUSAND ONE HUNDRED NINETY-SEVEN AND
62/100 DOLLARS ($3,448,197.62); and
WHEREAS, after due consideration by this Council, it is deemed advisable
to accept this tender on the basis of the terms set forth in its approval for
the improvements, as set forth in the form duly advertised and agreed to by
said bidder, and waiving all defects.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COUNCIL in and for the County
of Hawaii:
I
That the proposal for the improvements, as submitted by J. M. Tanaka
Construction, Inc., to furnish and pay for all material, including tools,
equipment and labor, necessary to construct and fully to complete the entire
general improvements in "Improvement District No. 10 - General Improvements
for Kaloko Mauka Subdivision", North Kona, Hawaii (Job No. P-1821), as set
forth in the specifications attached to said proposal be and the same is hereby
accepted by this Council, contingent upon the further progress of the proceed-
ings relating to said "Improvement District No. 10 - General Improvements for
Kaloko Mauka Subdivision", North Kona, Hawaii, to a final award of the contract
for the work in due course under the provisions of the Improvement District
Ordinance No. 350, and upon the understanding that upon notice of the final
award of this Council, said bidder will execute a contract for the work and
furnish bond as required by law and said specifications; said proposal for the
improvements being for the total sum of THREE MILLION FOUR HUNDRED FORTY-EIGHT
THOUSAND ONE HUNDRED NINETY-SEVEN AND 62/100 DOLLARS ($3,448,197.62).

That the Chief Engineer of the Department of Public Works be and he is
hereby directed and requested to prepare a corrected map and preliminary assess-
ment roll of said. "Improvement District No. 10 - General Improvements for Kaloko
Mauka Subdivision", North Kona, Hawaii, and a list of all known owners, lessees
and occupants of the land situated within said improvement district showing in
detail the proportionate amount proposed to be assessed against said land, all

in such form as may be used as a basis for a public hearing to be had respect-
ing the proposed assessment according to the provisions of said improvement
district ordinance.

That the County Clerk is hereby authorized and directed to notify said
bidder of the action herein taken and of the conditional acceptance of its bid
on its proposal for the general improvements according to the terms thereof;
and further notify the Chief Engineer of the Department of Public .Works to
prepare the data as herein requested and directed.
