HomeMy WebLinkAboutRES 547 Draft 01 1969-1972County of Hawaii—State of Hawaii Resolution No. 5-17 RESOLUTION RELATING TO "IMPROVEMENT DISTRICT NUMBER 10, NORTH KONA, HAWAII, APPROVING, ADOPTING AND RATIFYING THE ASSESSMENT REPORT OF THE CHIEF ENGINEER OF THE DEPARTMENT OF PUBLIC WORKS OF THE COUNTY OF HAWAII, PROVIDING FOR THE PAYMENT OF ASSESSMENTS AGAINST THE PROPERTY WITHIN SAID IMPROVEMENT DISTRICT, AND FOR SUCH BOND ISSUE AS SHALL BE NECESSARY, AND AUTHORIZING A PUBLIC HEAR- ING THEREON. WHEREAS, after due advertisement, tenders having been received and opened on June 22, 1972, relating to improvements within 11IMPROVEMENT DISTRICT NUMBER 10, NORTH KONA, HAWAII, all as heretofore established; and WHEREAS, the Chief Engineer of the Department of Public Works, as directed by the Council has caused a Map, Assessment Roll and Description of Properties of said ItIMPROVEMENT DISTRICT NUMBER 10, NORTH KONA, HAWAII." to be prepared, showing in detail the proportionate amounts per square foot proposed to be assessed against the property within said Improvement District,and a list of all known owners, lessees and/or occupants of the land within said Improvement District, all of which are incorporated in the report of said Chief Engineer, dated August 9, 1972, as provided by law; and WHEREAS, property owners of at least sixty percent of the area to be assessed in their duly acknowledged written consent submitted to the County Clerk by the Chief Engineer by letter dated August 4, 1972, and filed with the County Clerk on August 4. 1972, have consented to the increase in cost and in assessment rate for the said improvements; and WHEREAS, said report and proposed assessments have now been further and fully considered by this Council, and a public hearing on the basis thereof is now desirable and necessary; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: - I - That said Assessment Report of the Chief Engineer of the Department of Public Works, including the Map, Assessment Roll and Description of Properties, M be and the same are hereby approved, adopted and ratified as and for the I Map, Assessment Roll and Description of Properties for 11IMPROVEMENT DISTRICT NUMBER 10,, NORTH KONA, HAWAII, subject to such alterations., modifications and amendments as may hereafter be adopted according to law; said report being specifically referred to and incorporated herein. That all assessments made against the Property within said Improvement I District as set forth in detail in said Chief Engineerts Report, shall be payable within thirty (30) days after the date of the last publication of the assessment ordinance relating thereto, which shall be hereafter enacted; provided, that any such assessment may, at the election of the owner of said land assessed, be paid in twenty (20) approximately equal annual installments of principal and interest payable annually at a rate of eight per cent (8%) per annum, the first installment to be due and payable within thirty (30) days after the date of the last publication of the ordinance aforesaid; provided, however, that the method and rate of payment may be modified according to law, after the public hearing as hereinafter authorized. The Director of Finance shall add to each annual installment an amount equal to one half of one per cent (-1-2'/.) of the total amount of the installment, both principal and interest, to cover the expense of collec- tion. III That the County may issue sufficient improvement district bonds for 11IMPROVEMENT DISTRICT NUMBER 10, NORTH KONA, HAWAII, to raise such amounts as shall be due in deferred installments, said bonds to I be in such form as shall hereafter be adopted and prescribed by this Council, according to law; said bonds to be payable as prescribed by law and to be for a term not greater than the period allowed for installment payment of assessments; provided, however, that the form, terms interest and payment of said bonds may be modified according to law, after the public hearing as hereafter authorized. RESOLUTION NO. 547 - IV - That a public hearing before this Council sitting as a Board of Equalization, be had respecting the total amounts of said proposed several assessments, to be held before said Council at its Council Chambers in the City of Hilo on September 27, 1972, at the hour of 1.30 otclocrk p.m., or as soon thereafter as those interested may be heard. That the Clerk shall give notice on behalf of the Council, as required by law, to owners, lessees and occupants of the land within said Improvement District, as heretofore established, showing the total amount of the cost of the improvement based upon the bid of the lowest responsible and reliable bidder for the improvements and the rate per square foot for the improvements proposed to be charged to all the land within said Improvement District, and that the Map, Assessment Roll and Description of Properties relating to said Improvement Dis- trict may be seen and examined at the Division of Engineering office of the Chief Engineer of the Department of Public Works during business hours at any time prior to and during the date fixed for the hearing; and further give notice of the time and place of said public hearing respecting the proposed several assessments, at which public hearing the Council will sit as a Board of Equalization to receive objections or suggestions respecting the proposed several assessments, said notice to be published, posted, and mailed as provided by laws Dated at Hilo Hawaii this 23rd day of August , 1972.
