RESOLUTION CREATING, DEFINING AND ESTABLISHING IMPROVEMENT DISTRICT NUMBER
TWELVE KAUILA STREET SEWERS, IN THE DISTRICT OF SOUTH HILO, COUNTY OF HAWAII,
AND PROVIDING FOR THE IMPROVEMENT THEREOF.
WHEREAS, by Resolution No. 413, adopted October 20, 1971, the Mayor was
requested to direct the Chief Engineer of the Department of Public Works to
investigate and report preliminary data concerning the necessity, feasibility,
and method desirable for the construction of sanitary sewers for Kauila Street,
District of South Hilo, County and State of Hawaii, and to include in his report
all such data, surveys, maps, plans, drawings, details, specifications, and
recommendations as specified and called for in Section 3.1, Ordinance 350, as
amended; and
WHEREAS, the Chief Engineer did, in compliance with said Resolution No.
413, prepare and furnish the required data to the Council in his Preliminary Report,
dated March 1, 1972, relating to said improvement; and
WHEREAS, after notice duly given by publication commencing April 2, 1972,
in the Hawaii Tribune Herald, and by certified mail to the affected property
owners and lessees, a Public Hearing was duly held on April 18, 1972, at which
Public Hearing a quorum of the Council was present, and full opportunity was given
then and there to all persons interested to present suggestions or objections
with respect to the proposed improvement or any part or detail thereof; and
WHEREAS, prior to and at said Public Hearing held on April 18, 1972, five
written protest was filed against the proposed improvement, said protest having
been considered by this Council and thereafter filed; and after full hearing and
due consideration by this Council, the Public Hearing was closed and the matter
taken under advisement; and
WHEREAS, after further and full consideration, this Council did find and
declare that it still had jurisdiction thereof; and
WHEREAS, this Council, having now further and fully considered the plans
for the said improvement, has determined to proceed with the proposed improvement
substantially as set forth in said Chief Engineer+s preliminary report, without
materially altering the general character or plan thereof, as so advertised, and
without altering the assessment per square foot;
NOW THEREFORE, BE IT RESOLVED by the County Council of the County of Hawaii
as follows:
I. IMPROVEMENT DISTRICT CREATED:
That the proposed Kauila Street Sewers, Improvement District, in the
District of South Hilo, County and State of Hawaii, is hereby created, and
established as "IMPROVEMENT DISTRICT NUMBER TWELVE , KAUILA STREET SEWERS, the
limits and extent of which and the area to be assessed being hereby created,
defined, and established as shown on EXHIBIT I of said Preliminary Report, the
total assessed area being approximately 159,000 square feet.
II. CHARACTER, EXTENT, GENERAL DETAILS AND MATERIALS OF IMPROVEMENT DEFINED:
That the general character, extent and materials of the proposed improve-
ment, for which detailed specifications will be hereafter adopted, shall be and
are hereby defined and described as follows:
a. General: The Contractor shall furnish and pay for all labor,
tools, machinery and other equipment necessary to construct and
install complete, the sewers in every detail, ready for opera-
tion, in KAU ILA STREET S EWERS , IMPROVEMENT DISTRICT NUMBER
TWELVE , according to the plans and specifications to be
finally adopted for the work.
b. Order of Work: The order of work shall be as called for by the
Chief Engineer in the specifications.
c. Pipe: The pipe shall be vitrified clay sewer pipe. Joints shall
be made of approved pipe joint materials.
d. Manholes: Manholes shall be constructed in accordance with the
County of Hawaii Standards, circular in shape, with the bottom
and lower portions of concrete, the top portion of brick plastered
on the outside, or cast -in-place concrete, or of pre -cast concrete

pipe sections, frames and covers of cast iron, and rungs of
galvanized wrought iron or cast iron.
The general details of this proposed improvement shall be substantially
as set forth in the said Preliminary Report or as altered and modified by this
Resolution. Minor alteration and changes in work or materials may be made in
the details of any part or parts of this improvement, when such changes seem
necessary or advisable to the Chief Engineer, in order to complete the work in
a satisfactory manner. Any change or alteration shall not materially affect
the character or plans of this improvement as herefore advertised or set forth
by this Resolution, and shall be subject at all times to the approval of the
County Council,
III. PROPORTION OF COST TO BE BORNE BY THE COUNTY OF HAWAII:
That the County of Hawaii shall bear and pay the following portions
of the cost of said improvement:
a. The remainder of the cost of the improvement, after deducting the
cost to be borne by the property owners.
b. The cost of engineering, incidentals, advertising, and inspection,
all substantially as indicated by the terms of said Chief Engineer's
preliminary report.
IV. AREA TO BE ASSESSED AND METHODS AND RATE OF ASSESSMENT:
a. The cost of acquiring land and easements for the right-of-way and
all damaged incidental to this acquisition shall be part of the
cost of this improvement.
b. The entire cost of the improvement within IMPROVEMENT DISTRICT
NUMBER TWELVE , KAUILA STREET SEWER, except that portion to be
borne by the County of Hawaii, shall be assessed to the property
owners on an area basis at a rate of $0.06 per square foot for
agricultural, parks and recreation, preservation, public facilities
and utilities, military and cemetery general planned areas; $0.08
per square foot for residential; $0.10 per square foot for commercial

and industrial general planned areas; and $0.12 per square foot
for hotel, apartment, resort -hotel and public housing general
planned areas, which will be more exactly determined as to each
parcel of land within said Improvement District and the assess-
ments therefor.
C. That all said assessments may be paid in one (1) payment or in
twenty (20) equal annual installments of principal with interest
on deferred payments at the rate of eight percent (8%) per annum.
V. FINAL REPORT OF CHIEF ENGINEER:
That the Chief Engineer of the County of Hawaii is hereby requested
and directed, through the Mayor, to determine and specify with particularity all
of the matters and things requisite of proper for the full performance and comple-
tion of the work in accordance with the terms and intent of this Resolution, and
to prepare a Final Report of said Improvement District, showing the portion of
Kauila Street, District of South Hilo to be improved, and showing the exact loca-
tion of all improvements, together with final plans, drawings, details and specifi-
cations for the entire work; all in such form as will readily permit and encourage
genuine competition among contractors insofar as the materials specified will permit
of such competition, and in such form that the same may be used as the basis for
calling for bids for the entire work under one contract; and further, to submit the
same to this Council for approval.
