Your Committee on Finance, to which was referred Bill No. 273, reports as follows:
Bill No. 273, transmitted by Council Chairwoman Keiko Bonk -Abramson on May 2, 1996,
amends the Hawaii County Charter (1991), as amended, Article XIII, Section 13-1, Relating to
General Provisions.
The proposed amendment conforms the Hawaii County Charter to the Constitution of the State
of Hawaii and the Hawaii Revised Statutes, with the intent that as long as an elected official
fulfills his/her duties to the office there is no reason to force the elected official to vacate his/her
office because he/she is running for another office which begins after the current term ends.
Section 13-1 (f) (9) of the Hawaii County Charter would be amended to read: "Upon filing
nomination papers for another elective office [during the officer's own term of office] if the
term of the office sought begins before the end of the term of the office held."
Bill No. 2731 Draft 2 which incorporated some grammatical corrections in the intent and purpose
section of the bill was circulated.
Hypothetical examples of how this bill would work were discussed, and after some
consideration, Your Committee decided that it would be best to have continuity in council duties
by having the elected officer/candidate stay on to complete the term instead of having an interim
council member who is not familiar with council activities and operations.
Your Committee on Finance is in accord with the intent and purpose of Bill No. 273, Draft 2 -and
recommends it pass first reading.
