RESOLUTION AUTHORIZING AND DIRECTING ACCEPTANCE OF BID FOR
IMPROVEMENT DISTRICT BONDS FOR IMPROVEMENT DISTRICT NO. 10,
KAL O KO MAUKA , NORTH KO NA , HAWAII.
WHEREAS, by Resolution Nos. 564 and 565 adopted by the Council
of the County of Hawaii on October 11, 1972, the Director of
Finance was authorized and directed to prepare for sale and
to sell Improvement District Bonds in the amount not to exceed
$4,200,000.00 for Improvement District No. 10, Kaloko Mauka,
North Kona, Hawaii; and
WHEREAS, by notice of sale publicly advertised by the
Director of Finance, bids were called for the above sale to
be received at the office of the Treasury Division, Department
of Finance, County of Hawaii, on November 8, 1972, up to the
hour of 10:00 o'clock A.M.; and
WHEREAS, the only responsive bid submitted to the Director
of Finance when publicly opened at 10:00 o'clock A.M. on
November 8, 1972, was by the BANK of HAWAII of Honolulu, Hawaii,
for the entire issue of $4,200,000.00 (less the total amount of
assessments paid on or before November 6, 1972, if any) , which
bid was for $98.00 per $100.00 par value at interest rates of
6% on bonds maturing in 1973 and 8% on all other bonds; and
WHEREAS, the total amount of assessments paid on or before
November 6, 1972, was $43,936.957
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, STATE OF HAWAII:
Section 1. That the bid of the BANK OF HAWAII, whose
address is P.O. Box 2900, Honolulu, Hawaii 96802, offering
$4,072,941.79 for the entire issue of $4,156,063.05 par value
bonds of Improvement District No. 10, Kaloko Mauka, North Kona,
Hawaii, in accordance with Resolution Ncs.. 564: and 565 the notice
inviting bids and this resolution is the highest and best bid
for said bonds and said bid is hereby accepted and said bonds
awarded to said bidder.
Section 2, That the principal amount of said bonds, the
maturity schedule therefor, the denominations thereof and the
interest rates thereon shall be as set forth in Exhibit A
attached hereto and made a part of this Resolution.
Section 3. That all bids other than the one accepted
in Section 1 hereof are hereby rejected, and the Director of
Finance is directed to return the checks accompanying said
rejected bids to the respective bidders.
Section 4. That the Director of Finance is hereby
directed to issue said bonds as provided by law and to deliver
said bonds to the purchaser thereof upon receiving the purchase
price bid therefor plus accrued interest, if any.
