HomeMy WebLinkAboutRES 579 Draft 01 1969-1972County of Hawaii—State of Hawaii Resolution No. V9 PROVIDING FOR THE ACQUISITION OF LAND FOR A PUBLIC PARK, KEAUKAHA, WAIAKEA, DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: I. That it is necessary, for the public use and purpose, to wit: Expansion of James K. Kealoha Park, Keaukaha, Waiakea, District of South Hilo, County and State of Hawaii, to take, acquire, and condemn certain land with all improvements thereon and appurtenances thereunto belonging, in fee simple absolute, free and clear of all liens and encumbrances, hereinafter described and to that end and for these purposes the Corporation Counsel of the County of Hawaii be and he is hereby authorized and empowered to initiate proceedings in eminent domain, as provided by law, for the taking, acquisition and condemna- tion of Parcels 21, 22 and 51 of Tax Map Key 2-1-17, and more particularly described as follows: All of those parcels of land, being portion of Lehia Park Residence Lots and portion of Leleiwi Beach Park, Executive Order No. 267, situated at Waiakea, District of South Hilo, Island and County of Hawaii, State of Hawaii. Lot 5, area 17,649 square feet, as shown on Map 4 of Land Court Application 1229, filed in the office of the Assistant Registrar of the Land Court of the State of Hawaii, Being all of the land described in Transfer Certificate of Title No.129,673 and 130,956. Lot 87, area 20,000 square feet, all of Grant 9155 to Margaret L. Makanui, Parcel Map and Description "Attach"; Lots 2 and 3, area 10,000 square feet, as shown on Map 2 of Land Court Application 1229 filed in the office of the Assistant Registrar of the Land Court of the State of Hawaii, Being all of the land described in Transfer Certificate of Title No. 20,189. Lot 1, area 1.00 acre, being subject to Easement "All and Ease- ment "D" as shown on Map 2 of Land Court Application 1230, filed in the office of the Assistant Registrar of the Land Court of the State of Hawaii, Being all of the land described in Transfer Certificate of Title No. 30,819. II. That in the process of said proceedings in eminent domain, said Corporation Counsel be and he is hereby authorized and empowered to negotiate terms of settlement, subject to the approval of this Council and of the Court before which such proceedings are prosecuted.
