HomeMy WebLinkAboutRES 582 Draft 01 1969-1972County of Hawaii—State of Hawan Resolution No. �82 RELATING TO A GRANT OF VARIANCE FROM THE APPLICATION OF SECTION 4A OF ORDINANCE NO. 53 (DRIVEWAY APPROACHES), REVISED ORDINANCES OF THE COUNTY OF HAWAII, 1969, AS AMENDED, FOR PROPERTY DESCRIBED AS TMK 2-4-01, PARCELS 7, AT HILO, HAWAII. WHEREAS, Section 4A of Ordinance No. 53 (Driveway Approaches), Revised Ordinances of the County of Hawaii, 1967, as amended, prohibits the construction of driveway widths wider than thirty six feet; and WHEREAS, Section 8 of said ordinance provides that the Borad of Supervisors, now County Council, may, by resolution, grant variances fm m the strict applica- tion of the provisions of that ordinance after consultation with the Planning Commission, and under certain conditions, to wit: "A. The exception of variance desired arises from the developer wanting to provide wider ingress and egress driveways for smoother traffic flow within the parking area together with the full utilization of the limited area including landscaping. 11B. That the exception or variance desired is not against the public interest, particularly safety, convenience, and general welfare. ItC. That the granting of the permit for the exception or variance will not adversely affect the rights of adjacent property owners or tenants. ISD. That the strict application of the terms of this ordinance will work unnecessary hardship and practical difficulty on the property owner or tenant.If and WHEREAS, the County Council having consulted with the Planning Director and the Chief Engineer and having found that the above-mentioned conditions have been met; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that a variance from the application of Section 4A of Ordinance No. 53 be granted for the proposed driveway to Tax Map Key 2-4-0k Parcel 7, located along Kawili Street; and BE IT FURTHER RESOLVED that by this grant of variance it is understood that for the purpose of ingress and egress to the Hilo College Student Housing that the driveway may be constructed greater than thirty six feet but not more than sixty-five feet; and BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to Oda -McCarty, Architects, and the Chief Engineer and the Planning Director of the County of Hawaii.
