Poindexter, Chair and Members of the Hawai`i County Council FROM: Eileen O'Hara, Council Member SUBJECT: Proposed Amendments to Bill No. 108, Draft 6, an Ordinance Amending Chapter 25, Article 1, Article 2, Article 4, and Article 5, of the Hawai`i County Code 1983 (2016 Edition, As Amended), Relating to Short- Term Vacation Rentals. Please see below proposed amendments to Bill No. 108, Draft 6. The proposed amendments are illustrated in Ramseyer format with respect to the contents of Bill No. 108, Draft 6; material to be deleted is bracketed and stricken, and material to be added in is underscored. SECTION 2 of Bill No. 108, Draft 6,that amends section 25-4- , titled"Short-term vacation rentals" is amended by amending subsections (a) and (e) to read as follows: "(a) Short-term vacation rentals; where permitted, specific prohibitions. (1) Short-term vacation rentals shall be permitted in the: (A) V, CG, and CV districts; (B) Residential and commercial zoning districts, situated in the General Plan Resort and Resort Node areas; and (C) RM district, for multiple family dwellings within a condominium property regime as defined and governed by chapters 514A or 514B, Hawaii Revised Statutes. (2) Private covenants prohibiting use of any unit as a short-term vacation rental shall not be invalidated by this chapter. [(3) Special permits in the state land use agricultural district shall not be issued to permit short term vacation rentals in farm dwellings, pursuant to paragraph 205 4.5(a)(1), Hawaii Revised Statutes.]" Comm. In the event of a declared emergency, natural or manmade, and for purposes of economic recovery thereafter where [a significant number] at least 20% of nonconforming short-term vacation rentals are permanently lost within any given judicial district, the director shall assess the [effect] economic impact of such loss upon the affected district and [if deemed necessary,] initiate legislative and administrative opportunities to restore such loss in short-term vacation rental capacity within the district of origin."
