A BILL FOR AN ORDINANCE AMENDING CHAPTER 22 OF THE HAWAII COUNTY
CODE 1983 (1995 EDITION), AUTHORIZING THE COUNTY TO INSTALL SPEED
HUMPS ON COUNTY HIGHWAYS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The Council finds that the installation of speed humps on
certain county highways will increase highway safety in those areas. This section will authorize
the department of public works to utilize speed humps on county highways when and where it is
deemed appropriate.
SECTION 2. Chapter 22, Hawaii County Code 1983 (1995 edition), is amended by
adding a new division to article 1, to be appropriately designated and to read as follows:
"Division . Speed Humps.
Section 22- . Definitions.
U For purposes of this division unless it is plainly evident from the context that a different
meaning is intended, certain words and phrases used in this chapter are defined
hereinbelow:
"County highway" means every highway, street or roadway under the iurisdiction
and control of the County of Hawaii.
"Chief engineer" means the chief engineer of the public works department of the
County of Hawaii.
"Speed hump" means a gentle rise in the profile of the road that is used to
regulate the speed of a vehicle.
Section 22- . Powers and duties of chief engineer.
The chief engineer may
Q Construct, place, remove and repair speed humps on Countv hi hways when
deemed necessary for public safety.
Grant or deny requests from the public pursuant to this chapter for the placement or
removal of speed humps on county highways.
Section 22- . Requests for approval.
The chief engineer shall approve the requests as deemed appropriate. All requests for
speed humps must provide:
fah The name of the count- highway on which the speed humps are to be placed
The proposed location of the speed humps for the highway mentioned in (a�
Lc� The written consent of sixty percent of the property owners whose property abuts the
county highway within five hundred feet of the proposed speed hump All signatures
shall be verified by the public works department to ensure accuracy.
Section 22- . Process for approval.
The chief engineer shall review all requests for approval for location, design and
construction to ensure that they meet the guidelines as established in the "Guidelines for the
Design and Application of Speed Humps." Institute of Technical Engineers, May 1993, or as
subsequently revised.
Section 22- . Rules.
The chief engineer is authorized to adopt rules necessary to implement and administer the
provisions of this division."
SECTION 3. New material is underscored. In printing this ordinance, the underscoring
need not be included.
SECTION 4. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications

of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
