HomeMy WebLinkAboutBIL 230 Draft 02 1994-1996s ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 241 OF THE HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO VEHICLES AND TRAFFIC. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, article 8, division 4, section 24-216.01, of the Hawaii County Code 1983 (1995 edition), is hereby amended to read as follows: Section 24-216.01_ Flat rate payment option for Parking Meter Zones. [a)] (a) Persons parking in areas regulated by parking meters may choose to pay to the County a flat rate of ten dollars in lieu of placing coins in the appropriate meter as specified in Section 24-216. [b)] ibi Flat rate payments shall be submitted to the [Department of Public Works] finance director within ten working days of parking in a Parking Meter Zone without having placed the required coins in the appropriate parking meter. [c)] (c) Payment of this flat rate does not exempt a vehicle from any other provision of this Chapter prohibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times. [d)] (d) [When required, failure to submit a flat rate payment as specified herein shall be a violation of this section.] Any person failing to submit the flat rate payment to the finance director within ten working days shall be required to pay the flat rate plus a $50.00 processing fee for each permit when applying for or renewing their annual vehicle registration. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 4. This ordinance shall take effect upon its approval.
