Resolution No. 312
RELATING TO A GRANT OF VARI VCE FRM4 THE APPLICATION OF SECTIO'11\1 4A OF
ORDINANCE NO. 53 (DRIVEWAY APPROACHES), REVISED ORDIN.44CES OF THE COUNTY
OF HAWAII, 1969, AS X.,IZENDED, FOR PROPERTY DESCRIBED AS TMK 2-1-05,
PARCELS 24 AND 30 AT HILO, HA!VV'AII.
1,111-1EREAS, Section 4A of Ordinance No. 53 (Driveway Approaches), Revised
Ordinances of the County of Hawaii, 1967, as amended, prohibits the construc-
tion of driveway widths wider than thirty six feet; and
INHEREAS, Section 8 of said ordinance provides ghat the Board of Supervisors,
now County Council, may, by resolution, grant variances from the strict applica-
tion of the provisions of that ordinance after consultation with the Planning
Commission, and under certain conditions, to wit:
"A. The exception of variance desired arises from the developer
wanting to provide wider ingress and egress driveways for smoother traffic
flow within the parking area together with the full utilization of the limited
area including landscaping*
'1B. That the exception or variance desired is not against the public
interest, particularly safety, convenience, and general welfare*

That the granting of the permit for the exception or variance
will not adversely affect', the rights of adjacent property owners or tenants.
"Do That the strict application of the terms of this ordinance will
work unnecessary hardship and practical difficulty on the property owner or
tenant."

WHEREAS, the County Council having consulted with the Planning Director
and the Chief Engineer and having found that the above-mentioned conditions

have been met; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF H9VJAII that a variance
from the application of Section 4A of Ordinance Ho. 53 be granted for the
proposed driveway to Tax, fiap Key 2-1-05: Parcels 24 and 30, located or, the

that for the purpose of ingress and egress -1-10 the Viaiakea Peninsula Golf

Course Clubhouse -these drive -ways may be constructed greater than thirty six
feet but not more thar), eighty feet; and

to Alflo Ronco Development, Inc., and the Chief Engineer and the Planning
