Home My WebLink AboutRES 372 Draft 01 1969-1972County of Hawaii—State of Hawau Resolution No. 372 PROVIDING FOR THE ACQUISITION OF LAND FOR THE KISHI SUBDIVISION, IMPROVEMENT DISTRICT NO. 5 IN SOUTH KONA, COUNTY AND STATE OF HAWAII. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: I. That it is necessary, for the public use and purpose, to -wit: public road improvements in the Kishi Subdivision, Improvement District No. 5, South Kona, County and State of Hawaii, to take, acquire, and condemn certain land with all improvements thereon and appurtenances thereunto belonging, hereinafter described and to that end and for these purposes the Corporation Counsel of the County of Hawaii be and he is hereby authorized and empowered to initiate proceedings in eminent domain, as provided by law, for the taking, acquisition and condemnation of the land described as follows: Utility easement within Lot 42-A, being a portion of Lot 42 as shown on Map 2 of Land Court Application No. 1609 described in Certificate of Title No. 51965, containing an area of 30 square feet. II. That in the process of said proceedings in eminent domain, said Corporation Counsel be and he is hereby authorized and empowered to negotiate terms of settlement subject to the approval of this Council and of the Court before which such proceedings are prosecuted.
