WHEREAS, after due advertisement, tenders having been received and opened on April 229 19-171, relating to street and water improvements within "IlIvT ROVE - 1" '."ENIT DISTRICT 1 I0. 8 - LOT 718 SUBDIVISION ROAD OFF M,10HMA STREET," South Hilo, "Hawaii, all as heretofore established; and WHEREAS, the Chief Engineer of the Department of Public IJorks, as directed by the County Council has caused a Corrected 1"VI'lap, Preliminary Assessment Roll and Description of Properties of said "IfJdPROVEiLE11,111T DISTRICT NO. 8 - LOT '718 SUBDIVISION ROAD OFF KOTj'iOHX,,T,.A STREET," South Hilo, Hawaii, -to be prepared, showing in detail -the proportionate amounts per square foot proposed to be assessed against the property within said Improvement District, and a list of all l-,-nown owners, lessees and/ o -r occupants of the land within said Improvement District, all of which are incorporated in the report of said Chief Engineer, dated Julie 23, 1�,-_171, as provided by law; and MIEREAS, nineteen (19) property owners of at least sixty per cent of the area to be assessed in their duly acknowledged written Consent submitted to the County Clerk by the Chief Engineer by letter dated July 9, 1971, and 'riled with the County Clerk on July 9, 1971, have consented to the increases in cost and in assessment rate for the said improvements; and MHEREAS, said -report and proposed assessment and said Consent have now been further and fully considered by this Council, and a Public Hearing on the basis thereof is now desirable and necessary; THEREFORE, BE IT RESOLVED BY THE COU1,,TTY CODICIL in arid for -the County of Hawaii,-, I That said Preliminary Report on Assessment of the Chief Engineer of the Department of Public I'lo ks, dated June. 23, 1971, including the Corrected blap, Preliminary Assessment Roll and Description of Properties, be and the same are hereby approved, adopted and ratified as and for the Corrected h1jap, Preliminary Assessment Roll and Description of Properties for "Ilvi-PIROVEMETNT DISTRICT 1.10. 3 - LOT 713 SUBDIVISION ROAD OFF KOH10HANA STREET," South Hilo, Hawaii, sub; ,ect to such alterations, modifications and amendments as may hereafter be adopted according to lari; said report being specifically re- ferred to and incorporated herein. ii That: the assessment made against the property within said !Tiiprover.rient District as set forth in detail in said Chief Engineer's Report, shall be payable within thirty (30) days after the date of the last publication of the Assess-i'llent Ordinance relating thereto, which shall be hereafter enacted; provided, that such assessment may, at the.elec-11-lion of the ovrneT of said land assessed, be paid in twenty (21-2)) equal annual installments of principal, J- _L together with interest on unpaid principal payable annually at the rate of six- per cent (6;.Q;`) per annum, the first installment to be due and payable within thirty (30) days after the date of the last publication of the ordinance aforesaid; provided, however, that the method and rate of payment may be modified according to law, after the public hearing as hereinafter authorized.
