PROVIDING FOR THE ACQUISITION OF EASEMENT RIGHTS FOR THE
AIONA ROAD DRAINAGE IMPROVEMENTS, WAIAKEA, SOUTH HILO, HAWAII.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
That it is necessary, for the public use and purpose,
to wit: providing for the ;construction of drainage improvements
on Aiona Road, Waiakea, South Hilo, County and State of Hawaii,
to take, acquire and condemn the easement rights hereinafter
described and to that end and for that purpose the Corporation
Counsel of the County of Hawaii be and he is hereby authorized
and empowered to initiate proceedings in eminent domain, as
provided by law, for the taking, acquisition and condemnation
of the easement rights described as follows:
A 10 -foot slope easement designated S=1
over and, across a portion of Lot 1109,
Grant 11,682 to Edmond and Agnes Pacheco,
Waiakea Homesteads-,- 2nd Series, South Hilo,
Hawaii. TMK: 2-4-06:27 (portion) containing
an area of 398 sq. ft.
A 10 -foot slope easement designated S=2
over and -across a portion of Lot 1009,
Grant 111682 to Edmond and Agnes Pacheco,
Waiakea Homesteads-, 2nd Series, South Hilo,
Hawaii. TMK: 2-4-06:27 (portion) containing
an area of 1,982 sq. ft.
A 50 -foot drainage easement designated D-1
over and'across a portion of Lot 1009,
Grant 11,682 to Edmond and Agnes Pacheco,
Waiakea Homesteads-, 2nd Series, South Hilo,
Hawaii. TMK:' 2-4-06:27 (portion) containing
an area of 18,500 sq. ft,
That, in the process of said proceedings in eminent domain,
said Corporation Counsel be and he is hereby authorized and empowered

to negotiate terms of settlement, subject to the approval of this
Council and of the court before which such proceedings are prosecuted.

on a 20 -foot government roadway located off Hoaka Road along the

as Aioria Road) in Waiakea, South Hilo, County and State of Hawaii,
to take, acquire and condemn the easement rights hereinafter de-
scribed and to that end and for that purpose the Corporation Counsel
of the County of Hawaii be and he is hereby authorized and empowered
to initiate proceedings in eminent domain, as provided by law, for
the taking, acquisition and condemnation of the easement rights de-
scribed as follows:
