Resolution No. 424
RESOLUTION RELATING TO THE PROPOSED PERMANENT IMPROVEMENT FOR KALOKO
MAUKA SUBDIVISION ROAD IN KALOKO, DISTRICT OF NORTH KONA, HAWAII, UPON
AN AREA BASIS, ADOPTING THE PRELIMINARY REPORT OF THE CHIEF ENGINEER OF
THE DEPARTMENT OF PUBLIC WORKS AND PROVIDING FOR A PUBLIC HEARING.
WHEREAS, a petition dated September 14, 1971, was filed with the
County Clerk on September 14, 1971, (Comm. No. 1602) by the property
owners for a creation of an improvement district; and
WHEREAS, by Resolution No. 412, adopted by the Council of the
County of Hawaii on the 20th day of October, 1971, the Chief Engineer
of the Department of Public Works was ordered and directed to investigate
and report to said County Council preliminary data concerning the permanent
improvement of Kaloko Mauka Subdivision Road in Kaloko, District of North
Kona, County and State of Hawaii, in accordance with the provisions of
Ordinance No. 3509 as amended, and in accordance therewith said Chief
Engineer has submitted to this Council a report thereon, prepared by Boyle
Engineering, dated November 4, 1971, and filed with the Clerk of the County
of Hawaii on the 5th day of November, 1971, showing the necessary preliminary
surveys, maps, plans, drawings, and other data, details and specifications for
the proposed improvements, together with detailed estimates of the probable
cost thereof, and showing a description and the maximum unit of improvements
per square foot against the property subject to assessment therefor, in all
respects in the manner, form and detail as required by law, and as directed
in said Resolution No. 412; and
WHEREAS, said plans for said improvements so proposed in and by said
Resolution No. 412, and described in said Chief Engineer's Preliminary
Report thereon, prepared by Boyle Engineering, have now been further and
fully considered by this Council, and in the opinion of this Council, said
improvements are desirable and should be made; and
WHEREAS, the property owners by said Petition (Comm. No. 1602)
will bear the total cost of the proposed improvement;
NOW, THEREFORE, BE IT RESOLVED by the Council of the County of
Hawaii as follows:

That the plans and description, details and preliminary specifi-
cations for said proposed improvement of Kaloko Mauka Subdivision Road
aforesaid, so prepared by Boyle Engineering and presented to this Council
by said Chief Engineer and described in his said reports thereon now on
file as aforesaid, be and the same are hereby approved and adopted as and
for the preliminary surveys, maps, plans, drawings, details, and specifi-
cations for said proposed improvements, subject to such alterations and
amendments as shall hereafter be adopted according to law; all of which
are hereby incorporated and made a part of this resolution.
That the portion of Kaloko Mauka Subdivision Road proposed to be
improved lies in the land of Kaloko (TMK: 7-3-01, 08, 24, 25, 26 and 27),
as shown in the maps and plans accompanying said Chief Engineerls Prelimi-
nary Report, prepared by Boyle Engineering, dated November 4, 1971.
That it is proposed to pave the portion of Kaloko Mauka Subdivision
Road to be widened within the prescribed limits with a two (2) inch
asphaltic concrete surfacing course for a twenty (20) feet wide pavement

on a crusher run base course of not less than four (4) inches thick and
a sub -base course of not less than six (6) inches thick to place and roll
along both sides of the road pavement a minimum eight (.8) feet wide road
shoulder of select "aall in conformity with the established grades and
lines, to construct drainage facilities, to install culverts where needed
at driveways, to install street lights and to install water system as
shown in the aforementioned Preliminary Report.

That it is proposed to acquire land necessary for the purpose of
street widening within said Improvement District, as shown in the said
Preliminary Report.

That it is proposed that the costs of improvements be assessed on
an area basis; and it is also proposed to permit the owners to pay all
of said assessments in one payment or in twenty (20) approximately equal
annual installments of principal and interest at the rate of eight per
cent (80%) per annum, that the premium to be paid upon installments paid
in advance shall not exceed 5% of such advance payment and that the pro-
posed estimated units of assessments be $0.0398506687 per square foot for
those lands receiving 100% benefit, $0.0298880015 per square foot for
those lands receiving 75% benefit and $0.0199253344 per square foot for
those lands receiving 50% benefit for Assessment Zones I. III and II re-
spectively as shown in Exhibit VIII of the said Preliminary Report.

That it is further proposed that bonds bearing interest at a rate
not to exceed eight per cent (80%) per annum and maturing over a period
not to exceed 20 years from the date of said bonds, shall be issued to
represent assessments remaining unpaid 30 days after the date of the
last publication of the assessment ordinance relating thereto. Said
bonds shall be subject to call, but not prior to the second interest
payment date and annually thereafter, at premium not to exceed 5% of
the principal amount of such bond.

That it is further proposed that a reserve fund in the amount of
$35,000 be established from the proceeds of the sale of the bonds as
additional security for the payment of principal and interest on bonds
issued.
That the boundaries of said Improvement District and Zones I, II
and III thereof,, shall be shown on Exhibit A attached hereto and by
this reference made a part hereof.

That the report of the Chief Engineer of the Department of Public
Works including the plans and estimates of the water system, and such
other surveys, plans, maps and other data included in said report are
hereby approved and by this reference such report is hereby made a
part of this Resolution.

That a public hearing be had respecting said proposed improvements
before the Council of the County of Hawaii, at Kailua-Kona, Hawaii, on
the 17th day of January, 1972, at the hour of 7:30 p.m. or as soon
thereafter as those interested may be heard.

That the Clerk shall give notice on behalf of the Council, as re-
quired by law, generally to all owners, lessees and occupants of land
within said proposed area improvement and to all others interested of
the general character and extent of the improvements proposed, the
materials proposed to be used, the proposed method of assessments, the
areas to be assessed, the probable cost of said improvements, the part
or proportion of cost proposed to be borne by the County of Hawaii and
the estimated share of each estimate of cost per square foot for said
improvements, all according to said preliminary plans and specifications,
details and estimates so prepared by Boyle Engineering for said Petitioners,
and submitted and filed by said Chief Engineer together also with notice
that the map and general plans, details, specifications, estimates and
other data so prepared by Boyle Engineering for said Petitioners and
submitted by the said Chief Engineer with respect to the proposed improve-
ments, and herein approved and adopted by this Council for the making of
said proposed improvements, may be seen and examined by any person interested
at the Department of Public Works, at any time during business hours prior

to the date fixed and advertised for said public hearing thereon; and
further give notice of the time and place of said public hearing re-
specting the proposed improvements, and that a full opportunity will
then be given to all persons interested to present suggestions or
objections to the proposed improvements or to any part or detail thereof;
and further post similar notices conspicously at least ten (10) days prior
to the hearing approximately every two hundred and fifty ( 250) feet along
the street proposed to be improved; said notice to be given and published
in the form and manner required by Ordinance No. 350, as amended.
