HomeMy WebLinkAboutRES 427 Draft 01 1969-1972County of Hawaii—State of Hawaii Resolution No. 4z'7 RESOLUTION RELATING TO THE PROPOSED PERMANENT WATERLINE IMPROVEMENT OF CAPTAIN COOK HEIGHTS SUBDIVISION, UNIT I, KAAWALOA, SOUTH KONA, HAWAII, UPON AN EQUAL AREA BASIS, ADOPTING THE PRELIMINARY REPORT OF THE CHIEF ENGINEER OF THE DEPARTMENT OF PUBLIC WORKS AND PROVIDING FOR WAIVING OF A PUBLIC HEARING. WHEREAS, by Resolution No. 420, adopted by the Council of the County of Hawaii on the 3rd day of November, 1971, the Chief Engineer of the De- partment of Public Works was ordered and directed to investigate and report to said Council, preliminary data concerning the permanent improvement of Captain Cook Heights Subdivision, Unit I. Kaawaloa, South Kona, County and State of Hawaii, in accordance with the provisions of Ordinance No. 3501, as amended, and in accordance therewith said Chief Engineer has prepared and submitted to this Council a report thereon, dated November 17, 1971,and filed with the Clerk of the County of Hawaii on the 17th day of November, 1971, show- ing the necessary preliminary surveys, maps, plans, drawings, and other data, details and specifications for the proposed improvements5 together with de- tailed estimates of the probable cost thereof, and showing a description and the maximum unit of improvements per square foot against the property subject to assessment therefor, in all respects in the manner, form and detail as re- quired by law, and as directed in said Resolution No. 420; and WHEREAS, said plans for said improvements so proposed in and by said Resolution No. 420, and described in said Chief Engineer's Preliminary Report thereon, have now been further and fully considered by this Council, and in the opinion of this Council, said improvements are desirable and should be made; NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii as follows: M MAE That the plans and description, details and preliminary specifi- cations for said proposed improvement of Captain Cook Heights Subdivision, Unit I. Kaawaloa,, South Kona, Hawaii,, aforesaid, so prepared and presented to this Council by said Chief Engineer and described in his said reports thereon now on file as aforesaid, be and the same are hereby approved and adopted as and for the preliminary surveys, maps, plans, drawings, details, and specifications for said proposed improvements, subject to such altera- tions and amendments as shall hereafter be adopted according to law; all of which are hereby incorporated and made a part of this resolution. That the section of waterline proposed to be improve lies within the Captain Cook Heights Subdivision, Unit I., Kaawaloa9 South Kona., Hawaii., as shown in the maps and plans accompanying said Chief Engineer's Preliminary Report., dated November 17, 1971. That it is proposed to construct a waterline within the Captain Cook Heights Subdivision, Unit I. Kaawaloa., South Kona., Hawaii, in conformity with the standard specification of the Department of Water Supply, as shown on Exhibit IV of said Chief Engineer's Preliminary Report. - IV - That it is proposed that the cost of waterline improvements be assessed on an equal area basis (pro -rated equally among the 23 participants - Pet. 18.4/ PWC 67) and to permit the owners to pay all of said assessments in one (1) payment or in twenty (20) equal annual installments of principal with interest on deferred payments at the rate of six per cent (6%) per annum; that the maximum unit of assessments be $0.0713333 per square foot for waterline im- provements against the benefited owner, RESOLUTION NO* 427 - V - That a public hearing be waived in accordance to Section 3.4, Ordinance No. 350., as amended, petition by owners of one hundred per cent of frontage or area. - VI - That the filing of notice on behalf of the Council by the Clerk to the owners, lessees, and occupants of the lands within the Captain Cook Heights Subdivision, Unit I, Kaawaloa, South Kona, Hawaii, pro- posed to be assessed, and to all persons interested generally, be also waived pursuant to aforementioned Section 3.4, Ordinance No. 350, as amended.
