HomeMy WebLinkAboutRES 428 Draft 01 1969-1972County of Hawaii—State of Hawaii Resolution No. 4?8 RESOLUTION CREATING, DEFINING AND ESTABLISHING "IMPROVEMENT DISTRICT NO. 9 CONSTRUCTION OF WATERLINE FOR CAPTAIN COOK HEIGHTS SUBDIVISION, UNIT I.IfKAAWALOA, DISTRICT OF SOUTH KONA, COUNTY OF HAWAII, AND PROVIDING FOR THE IMPROVEMENT THEREOF. WHEREAS, by Resolution No. 420 adopted November 3, 1971, the County Council ordered and directed the Chief Engineer of the Department of Public Works to investigate and report to the County Council preliminary data concerning the necessity, feasibility and method desirable for the permanent waterline improvement in Kaawaloa, District of South Kona, County and State of Hawaii,, in accordance with the provisions of Ordinance No. 350, as amended; and WHEREAS, said Engineer has prepared and submitted to this Council a report thereon., dated November 17, 1971, and filed with the Clerk of the County of Hawaii on November 17, 1971,showing the necessary preliminary surveys, maps, plans, drawings, and other data, details and specifications for the proposed improvements, together with detailed estimates of the pro- bable cost thereof,, and showing a description and the maximum units of im- provements per square foot against the property subject to assessment therefor, in all respects in the manner, form and detail as required by law, and as directed in said Resolution 420; and WHEREAS, by 100% petition the petitioners proposed said waterline im- provement district, the cost of which is to be borne IOTI. by the benefited property owners, (Petition 18-4/PWC 67) a public hearing need not be held in accordance with Section 3.4, Ordinance No. 350, as amended, petition by owners of one hundred per cent of frontage or area; and WHEREAS. said Council approved the Preliminary Report by Resolution 427 adopted December 1, 1971; WHEREAS, said Council having now further and fully considered all and singularly the plans for said improvements and all objections, protests and suggestions presented or offered with respect thereto, has now determined to proceed with the proposed improvements substantially as set forth in said Chief Engineer's preliminary report, as petitioned by the property owners; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL of the County of Hawaii as follows: I. IMPROVEMENT DISTRICT That the proposed Captain Cook Heights Subdivision, Unit I, Waterline Improvement District in the District of South Kona, County and State of Hawaii, is hereby created, defined and established as ItIMPROVEMENT DISTRICT NO.9 - WATERLINE IMPROVEMENT FOR CAPTAIN COOK HEIGHTS SUBDIVISION, UNIT I," Kaawaloa, District of South Kona, Hawaii, the limits and extent of which, and the area to be assessed being more particularly created, defined and established as follows: DESCRIPTION OF BOUNDARY FOR "IMPROVEMENT DISTRICT NO. 9 WATERLINE IMPROVEMENT FOR CAPTAIN COOK HEIGHTS SUBDIVISION, UNIT I KAAWALOA, DISTRICT OF SOUTH KONA, HAWAII Being a portion of Captain Cook Heights Subdivision Unit I. said subdivision being a portion of R.P. 4386 and R.P. 7532, L.0 . Aw. 8452, Apana 10, to A. II. CHARACTER, EXTENT AND GENERAL DETAILS AND MATERIALS OF IMPROVEMENT DEFINED A. That the general character, extent and materials of the proposed improvement for which detailed specifications shall hereafter be adopted, shall be and are hereby described and defined as follows: 1. WATER SYSTEM: The water system shall consist of the installation of 1,368 lineal feet of six (6) inch ductile iron water main including valves, 428 - RESOLUTION 8RESOLUTION N0. fittings, fire hydrants, surface laterals and appurtenances, as shown on the drawings and in accordance with the requirements of the Department of Water Supply. The estimated cost of the water system is $21,356.00 and the cost shall be borne in its entirety by the property owners. B. The general details of the proposed improvements shall be sub- stantially as set forth in said Chief Engineer's preliminary report, the improvement of the water system as petitioned by the property owners, and maps and other exhibits accompanying same (incorporated herein by reference), as by this resolution altered, and modified, providing that minor alteration and changes in work or materials may be made in the details of any part of said improvements as shall, in the judgement of the Chief Engineer, seem necessary or advisable to complete the same in an efficient and satisfactory manner and subject always to the approval of this Council. LANDS TO BE ACQUIRED There will be no lands to be acquired. IV. PORTION OF COST TO BE BORNE BY THE COUNTY OF HAWAII That the County of Hawaii shall bear and pay out of general revenues the following portions of cost of said improvement district: 1. One Hundred percent (100%) of the cost for engineering, incidentals and inspection. V. AREAS TO BE ASSESSED AND METHODS AND MAXIMUM RATE OF ASSESSMENT A. That the entire cost of the improvements within "IMPROVEMENT DISTRICT NO. 9 - WATERLINE IMPROVEMENT FOR CAPTAIN COOK HEIGHTS SUBDIVISION, UNIT I", Kaawaloa, South Kona, Hawaii and all general expenses not otherwise RESOLUTION N0. 428 M provided less one hundred percent (100%) of the cost of the engineering, incidentals and inspection, shall be provided by general assessment on an equal area basis against all of the assessable lands within the limits of the before described improvement district. B. That the cost of the waterline improvement shall be provided by assessment on an equal area basis at a rate not to exceed $0.0713333 per square foot against all of the lands to be served within the limits of the before described improvement district. The net total assessable area is approximately 345,000 square feet, and to be hereafter more exactly determined as to each portion of land within said improvement district and the respective assessment therefor. C. That all of the area within said improvement district shall be subject to assessment, all as shown on Exhibit II of said Chief Engineer's preliminary report and incorporated herein by reference. D. That the assessment shall be payable in one payment or in twenty (20) equal annual installments, with interest on the unpaid installments at the rate of sic percent (6%) per annum. Vi. FINAL REPORT OF CHIEF ENGINEER That the Chief Engineer of the Department of Public Works, County of Hawaii,, is hereby requested and directed to determine and specify with particularity all of the matters and things requisite or proper for the full performance and completion of the work in accordance with the terms and intent of t1ib resolution and to prepare a corrected map of said improvement district and the separate parcels of land abutting thereon with the area thereof, and showing the exact location of all improvements, together with final plans, drawings, details and specifications for the entire work; all in such form RESOLUTION NO. 428 I as will readily permit and encourage genuine competition between contractors insofar as the materials specified will permit of such competition and in such form that the same may be used as the basis for calling for bids for the entire work under one contract, and further to submit same to this Council for its approval. VII. FINAL REPORT OF DEPARTMENT OF WATER SUPPLY A. That the Department of Water Supply, County of Hawaii, is hereby requested to furnish final detail plans and specifications for the water system for said improvement district, all in such form as will readily permit and encourage genuine competition between contracts insofar as the materials specified will permit of such competition, and in such form so the final plans and specifications so furnished by said Department of Water Supply may be used as the basis for the calling for bids for such water system in its entirety under one contract, and further to submit same to this Council for its approval. B. That the Chief Engineer of said Department of Public Works is hereby requested and directed to furnish said Department of Water Supply with such copies of the final surveys, maps and plans covering said improvement district, as required in Paragraph VI hereof other than for such water system, as may be necessary to enable said Department of Water Supply to prepare the final plans and specifications for such water system.
