Resolution No. 4,18
WHEREAS under C -1586 -PWC -64 (meeting of September 22, 1971) the
County Council agreed to bear all land acquisition and construction
costs on a reimbursable basis for connection of Haunani Road and
Lanihuli Road from the Volcano Road (Route No. 11) to the proposed
realigned I'Volcano Road, 29 Mile Post to 26 Mile Post, Project No.
F-011-2(4)11, State Highways Division; and
WHEREAS by Letter HWY-RL 3.33231 (dated December 10, 1971) to
the Chief Engineer, Department of Public Works, County of Hawaii, the
State Highways Division requested a resolution from the County Council;
THEREFORE, BE IT RESOLVED BY THE COUNTY COUNCIL in and for the
County of Hawaii, at a meeting held this date, that the County of Hawaii
hereby
a. Authorizes the County of Hawaii to enter into an agreement with
the State of Hawaii for the land acquisition and construction
of the connector roads;
b. Declares the need for connecting access roads from the proposed
bypass to the Volcano town and farm lands;
c. Declares that $85,,000 is being proposed in the FY 1972-1973
C.I.P.;
d. Indemnify and hold harmless the State of Hawaii, its officers
and employees from any liability arising under such an agreement;
BE IT FURTHER RESOLVED that the County Clerk be and he is
hereby directed to forward a copy of this resolution to the State
Highways Division, Department of Transportation, State Highways
District Engineer, Hawaii; and to any interested government or
government agency.
