RE: Appointments to the Police Commission
This is in response to your July 30, 19991etter to this office in which you asked
whether or not Francis Smith could be appointed to a teen on the Police Commission
which would end on December 31, 2000. You have pointed out that when the Police
Commission was expanded from seven members to nine, §7-2.2 of the Hawaii County
Charter was amended to read as follows:
To allow for the staggering of terms, one of the new commissioners will be
appointed for a regular term, while the other will be appointed for aone-year term,
and shall be eligible for a second term in accordance with Section 13-4(c), Hawaii
County Charter.
As you noted, the intent of the drafters and the voters was that one of the new
commissioners appointed after the amendment took effect would be eligible to serve for
six years instead of the normal five.
It is our understanding that the nomination of Francis Smith has been withdrawn
from the consideration of the County Council. This office will therefore take no further
action on this matter unless requested to do so.
