Resolution No. 28-2
RESOLUTION REQUESTING THE STATE LAND USE COMMISSION TO RESCIND
ITS PETITION TO RECLASSIFY 220 ACRES FROM URBAN TO AGRICULTURE
AND CONSERVATION AT NINOLE, KAU, HAWAII.
WHEREAS, on November 20, 1969, the State Land Use Commission
approved changes in land use in Ninole, Kau, Hawaii, from
Agricultural to Urban and from Conservation to Urban; and
WHEREAS, on January 18, 1972, the Hawaii County Council
by Ordinance No. 443, approved the changes in zoning in Ninole,
Kau; and
WHEREAS, 120 acres mauka of the existing Belt Highway
bearing TMK 9-5-19 portion of 19 and 24, are presently developed
and contain three holes of the Ninole Golf Course complete with
underground irrigation system, extensive flood control improve-
ments to Ninole Stream channel, a 1 million gallon concrete
water storage reservoir complete with booster pumps and trans-
mission piping, preliminary grading of the entire area, two
completed model homes, and preliminary plan approval by the
Hawaii County Planning Department for a small 1/2 acre subdivision;
and
WHEREAS, 100 acres makai of the existing Belt Highway
bearing TMK 9-5-19 portion of 11 and 31, are presently developed
and contain an operating golf clubhouse, six holes of Ninole
Golf Course complete with underground irrigation system,
extensive flood control improvements to Ninole Stream channel,
2 domestic water wells complete with pumps and transmission
piping presently serving Punaluu Village Restaurant and surrounding
area including Punaluu County Park 1 1/2 miles distant, complete
waste water treatment plant facilities including transmission
sewer pump and piping, project office, maintenance buildings,
grading of entire area, including extensive subsurface drainage
control aqueducts; and
WHEREAS, the makai area contains the potential sight of
the Aspen Institute of Humanistic Studies and is adjacent to
a 50 unit condominium development presently under construction
and a completed major arterial which connects to the existing
Punaluu Road; and
WHEREAS, the developer, Hawaiiana Investment Company, a
Brewer Company, has in good faith expended in excess of 8 million
dollars and has met and fulfilled its obligations in compliance
with existing applicable statutes and ordinances; and
WHEREAS, the State Land Use Commission's petition to
reclassify these areas creates a potential loss in economy
within the district and loss in real property tax revenues
to the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that it strongly recommends that the State Land
Use Commission rescind its petition and reaffirm its prior
support of the present land use classification.
BE IT FURTHER RESOLVED that the Clerk of the County of
Hawaii be and is hereby directed to.transmit true copies of
this resolution to the Honorable Bruce McCall, Mayor of the
County of Hawaii; Mr. Raymond Suefuji, Planning Director,
County of Hawaii; each member of the State Land Use Commission;
and Mr. Murray Stewart, President of C. Brewer and Co., Ltd.
