1. APPLICANT: RUTH W. WARD -Applications for a State Land Use Boundary
Amendment from Agricultural to Urban and a Change of Zone by changing the district
classification from Agricultural (A-la) to Village Commercial (CV-10) for
approximately 23,196 squaze feet of land. The property is located on the east side of
the town of Pahoa directly across of the Pahoa High School, Puna, Hawaii,
TMK: 1-5-6:23.

2. PLANNING DIRECTOR -Initiation of proposed bill to amend Chapter 25 (Zoning
Code) of the Hawaii County Code, relating to telecommunication antenna. The
proposed amendments are to clarify the districts where telecommunication antenna
would be a permitted use, and also to address the recent Supreme Court decision
whereby a special permit would be required for telecommunication antenna on a
building site situated within the State Land Use Agricultural District.

3. COUNTY COUNCIL REFERRAL BILL NO. 75 -Amend the bill relating to a
request filed by NANAWALE ESTATES CO. for a Change of Zone by changing the
district classification from Open (O) to Residential and Agricultural (RA-2a) for
approximately 10.995 acres of land. The original request was from Open (O) to
Residential and Agricultural (RA-la). The property is located within Nanawale Estates
Subdivision bordered by Holiday Road, Flower Road and Seadrift Road at Puua, Puna,
Hawaii, TMK: 1-4-47:87.

4. COUNTY COUNCIL REFERRAL BILL NO. 76 -Amend the bill relating to a
request filed by NANAWALE ESTATES CO. for a Change of Zone by changing the
district classification from Open (O) to Residential and Agricultural (RA-2a) and
Agricultural (A-5a) for approximately 23.203 acres of land. The original request was
from Open (O) to Residential and Agricultural (RA-la) and Agricultural (A-Sa). The
property is located within Nanawale Estates Subdivision bordered by Kapuna Road,
Niihau Road, Kehau Road and Molokai Road at Puua, Puna, Hawaii,
TMK: 1-4-59:77.

5. COUNTY COUNCIL REFERRAL BILL NO. 77 -Amend the bill relating to a
request filed by NANAWALE ESTATES CO. for a Change of Zone by changing the
district classification from Open (O) to Family Agricultural (FA-2a), for approximately
9.328 acres of land. The original request was from Open (O) to Family Agricultural
(FA-la). The property is located within Nanawale Estates Subdivision bordered by
Hapuu Road and Kona Road at Puua, Puna, Hawaii, TMK: 1-4-76:38.

6. COUNTY COUNCIL -Continued hearing on the initiation of proposed amendments
to Section 6-2 of Chapter 6 Article 1 (Cemeteries), Hawaii County Code, relating to
application for cemeteries. The proposed amendments include the designation of the
Planning Director to process an application; the requirement of a license issued
pursuant to Chapter 441, Hawaii Revised Statutes, relating to Cemetery and Funeral
Trusts; and to increase the deposit fee from $100 to $250 to cover the cost of
publication of notices and other expenses.

7. PLANNING COMMISSION -Continued hearing on the initiation of proposed
amendments to Rule 9 of the County of Hawaii Planning Commission's Rules of
Practice and Procedure. The amendments aze being proposed to bring Rule 9 into
conformance with changes made to Chapter 205A, Hawaii Revised Statutes, and also to
include certain procedural requirements.

ADJOURNMENT
The purpose of the public hearings is to afford all interested persons a reasonable
opportunity to be heard on the above requests. According to Rule 1 (General Rules) of the
Planning Commission, a person desiring to submit oral or written testimony shall indicate
her/his name; residence address; and whether the testimony is on her/his behalf or as a
representative of an organization or individual. If testimony is being submitted on behalf of an
organization, documentation showing membership ratification should accompany the
testimony. Written testimony shall be submitted with an original and nine copies prior to
testifying. The Commission would appreciate timely submittal to the Planning Department at
least one week prior to the heazing date to allow for mailing and thorough Commission
review. Testimony which is irrelevant or unduly repetitious may be limited by the
Chairperson pursuant to Rule 1.
Maps showing the general location and boundazies of the areas under consideration
and/or plans of the proposed developments, and copies of the proposed amendments to the
Planning Commission Rule No. 9, and the Hawaii County Code are on file and open to
inspection during office hours at the Planning Depaztment, County Building, 25 Aupuni Street,
Room 109, Hilo, Hawaii 96720. Copies of the proposed amendments to the Planning
Commission Rule No. 9, and the Hawaii County Code are also on file and open to inspection
during office hours at the Planning Department West Hawaii Office, 75-5706 Kuakini
Highway, Suite 109, Kailua-Kona, Hawaii 96740.
