Your Committee on Planning,to which was referred Bill No. 15, reports as follows:
Bill No. 15,transmitted by Mayor Harry Kim via Communication No. 63, dated January 4, 2019,
amends Ordinance No. 97-13 which reclassified lands from Single Family Residential— 10,000
square feet(RS-10) to General Commercial—20,000 square feet(CG-20) at Waiakea, South Hilo,
Hawai`i, covered by Tax Map Key: 2-2-023:012.
Mayor Kim forwarded the Windward Planning Commission's favorable recommendation to grant a
five-year extension of time to comply with Condition C (Complete Construction), an amendment to
Condition B (time to secure water), and that the initial administrative time extension condition(current
Condition H) be retained as part of the amendment request.
Planning Consultant Sidney Fuke appeared before the Committee on behalf of the applicant,Nelson and
Susan Fukuhara. Mr. Fuke noted that the property in question was a corner lot at the intersection of
Kamana and Kino`ole Streets, near the senior activity center. He pointed out that the applicant had full
intention to relocate their current office when the original ordinance went into effect, but the economic
recession of 2008 put a halt to relocation plans. By the time they were ready to reconsider moving on
construction,they required his assistance as a planning consultant to help them with the extension
requests as the ordinance had lapsed. He explained that since the passage of the concurrency
requirement, all outdated original requests must be re-reviewed to make sure that they comply with
current ordinances. He assured the Committee that the project meets all tests and has thus far been
received favorably by those reviewing it.
Committee Vice Chair Susan L. K. Lee Loy stated she wanted to ensure, as she does with all applicants,
that they are aware of and agree with all conditions as listed. She further thanked Mr. Fuke for
proactively noting that the concurrency requirements had been met, particularly regarding the
reevaluation of traffic impacts and adjustments for Condition B (time to secure water).
The vote was then taken on the motion to move this measure to council with a positive recommendation
and passed unanimously with nine "ayes."

Your Committee on Planning is in accord with the purpose and intent of Bill No. 15, and recommends
its passage on first reading.
