Re: Operating Budget
Enclosed is a bill for an ordinance appropriating an additional $9,843 to the
Civil Defense Agency from the State Department of Business, Economic
Development and Tourism, which is the balance due the County of Hawai i
from the Hawaii State Act 182 emergency planning project. These funds are to
be used for supporting energy emergency preparedness activities. Also enclosed
is a Letter of Agreement dated April 26, 1999 from the Energy Program
Administrator of DBEDT.
Also enclosed is a resolution authorizing the County of Hawaii to enter into an
agreement with DBEDT.

A. REQUEST:
A County Council Resolution authorizing acceptance of NINE THOUSAND
EIGHT HUNDRED FORTY THREE and NO/100 DOLLARS ($9,843.00) from the
State Department of Business, Economic Development and Tourism, DBEDT.
Also an Ordinance amending the budget to include these funds.
B. BACEGROUND AND JUSTIFICATION (U~5 ADDITIONAL SHEETS AS NEEDED):
These funds are the balance due Hawaii County from the Hawaii State
Act 182 energy emergency planning project, and are to be used for
the purposes of supporting energy emergency preparedness activities
in Havaaii County. Refer to the attached letter of Agreement, dated
April 26, 1999, from the Energy Program Administrator of DBEDT.

LETTER OF AGREEMENT

Dear Mc Carr:
This letter confirms an Agreement between the Department of Business, Economic Development, and
Tourism (DBEDT), hereinafter referred to as STATE by its Director's Designated Representative, Maurice H. Kayo,
Energy Program Administrator, (REPRESENTATIVE) and the County of Hawaii, hereinafter referred to as
COUNTY whose principal address is 25 Aupuni Street, Room 219, Hilo, Hawaii 96720, Taxpayer I.D. # 99-6000

The parties hereto agree to the terms, conditions, and provisions as follows:
1. Scone of Services. STATE shall transfer the balance of funds due to the COUNTY from the Act 182
energy emergency planning project. The COUNTY acceptance of funds is in accordance with the
COUNTY'S Agreement with the STATE to use funds for the purposes of supporting energy emergency
preparedness (EEP) activities, as provided by the provisions of Act 182, SLH 1992. In accordance with
Act 182, SLH 1992, COUNTY shall make the determination of the specific EEP activities to be supported.
2. Time of Performance. The services described herein shall commence on the effective date of this
agreement, and shall be deemed completed upon transfer of the funds by STATE to the COUNTY.
3. Transfer of Funds. STATE agrees to pay COUNTY $8,449.00 plus 3% (simple) interest. Interest
accumulation shall be for the period July 1, 1993 to December 31, 1998. Total sum to be transferred
including interest is NINE THOUSAND EIGHT HUNDRED FORTY-THREE and NO/100 DOLLARS
($9,843.00)
4, General Conditions. The State of Hawaii, Department of Business, Economic Development, and Tourism
General Conditions is attached hereto and made a part of this Agreement. In the event of a conflict between
the General Conditions and the Special Conditions of this Agreement, the Special Conditions shall control.
