Resolution
WHEREAS, Section 2 of Ordinance No. 69 provides that the
County Council may, by resolution approve by a majority of its
members, dispose of real property; and
WHEREAS, the County acquired the former Carvalho property
adjacent to Harry K. Brown Park, Kalapana, Hawaii, TMK 1-2-03-47,
and the former Souza property adjacent to Kaimu Beach, Kalapana,
Hawaii , TMK 1-02-04-33 for the purpose of park expansion;
WHEREAS, the buildings are surplus and must be removed
prior to commencement of work on improvement of the parks;
NOW THEREFORE BE IT RESOLVED that:
1. In accordance with the provisions of Ordinance No. 69 ,
the Director of Finance be authorized to dispose the following
buildings only by public auction:
a. The cottage on the land formerly owned
by Anthony Carvalho, situated adjacent
to Harry K. Brown Park, Kalapana, Hawaii ,
TMK 1-2-03-47;
b. The cottage on the land formerly owned
by Louis Souza, situated at Kaimu Beach,
Kalapana, Hawaii , TMK 1-2-04-33.
2. The Director of Finance to determine the date, place,
and reasonable terms and conditions of the auction;
3. If no acceptable bids are received, that the buildings
be demolished and removed expeditiously.
