Resolution
WHEREAS, Section 2 of Ordinance No . 69 provides that the
County Council may, by Resolution approve by a majority of its
members, dispose of real property; and
WHEREAS, Act 265 transferred all real property to the State,
Department of Education, for the purpose of operating and maintaining
the school, without cost to the State or reimbursement to the County;
WHEREAS, within 10 years after the effective date (January 1,
1970) any property abandoned or ceases to be used for the purpose
stated in the preceding paragraph, shall be returned to the County;
WHEREAS, the building located at Mt . View School is surplus and
must be removed prior to commencement of work on construction of a
new library building at Mt . View.
NOW THEREFORE BE IT RESOLVED THAT :
1. In accordance with the provisions of Ordinance No . 69, the
Director of Finance be authorized to dispose of the building located
at Mt . View School, Mt . View, Hawaii, TMK: 1-$-01-7, by public
auction.
2 . The Director of Finance to determine the date, place, and
reasonable terms and conditions of the auction.
3 . If no acceptable bids are received, that the building be
demolished and removed expeditiously.
