HomeMy WebLinkAboutRES 389 Draft 01 1972-1976 County of Hawaii--State of Hawaii Resolution WHEREAS, Section 2 of Ordinance No. 69 provides that the County Council may, by Resolution approve by a majority of its members, dispose of real property; and WHEREAS, Act 265 transferred all real property to the State, Department of Education, for the purpose of operating and maintaining the school, without cost to the State or reimbursement to the County; WHEREAS, within 10 years after the effective date (January 1 , 1970) any property abandoned or ceases to be used for the purpose stated in the preceding paragraph, shall be returned to the County; WHEREAS, the building located at Mt. View School (one building) and Kailua-Kona School (two buildings) are surplus and must be removed prior to commencement of work on construction of a new library building at Mt. View and phasing out the school at Kailua-Kona. NOW THEREFORE BE IT RESOLVED THAT: 1. In accordance with the provisions of Ordinance No. 69 , the Director of Finance be authorized to dispose the following buildings only by public auction: a. The building located at Mt. View School, Mt. View, Hawaii, TMK-1-8-01-7 b. The buildings (two buildings) located at Kailua-Kona School , Kailua-Kona, Hawaii , TMK-7-5-08-13. 2. The Director of Finance to determine the date, place, and reasonable terms and conditions of the auction. 3. If no acceptable bids are received, that the buildings be demolished and removed expeditously.
