Hawai`i County Council 25 Aupuni Street Hilo, Hawai`i 96720 Re: Operating Budget Ordinance 18-114 establishes the Short Term Vacation Rental Enforcement Fund, with - regulation of short-term vacation rentals by the Planning Department. Expenses shall be funded by all fees and fines collected in connection with the administration and enforcement of this program. Enclosed is a bill for an ordinance amending the Operating Budget by appropriating $800,000 into Planning's Short Term Vacation Rental Enforcement S&W, OCE and equipment accounts. This appropriation reflects funds anticipated to be received during the current fiscal year. The bill sets up the proper accounts to receive and expend the funds. The,Planning Department requests that this bill be waived from the Finance Committee and be placed on the March 28, 2019 Council agenda in order to implement this program as soon as possible. REQUEST: Request a bill for an ordinance to appropriate $800,000 to the Short Term Vacation Rental Enforcement Fund for FY 2018-2019,too revenue.account 035.320.1.91 and expense.account 035.1.41.5.146.01. Funds will be used (1)to hire temporary workers to implement Ordinance 2018-114 and (2) to purchase software to facilitate enforcement after this ordinance takes effect on April 1, 2019. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): Per Ordinance 2018-114, the.Planning.Department is responsiblefor the regulation of Short Term.Vacation. Rentals. The Department will determine where Short Term Vacation Rentals are allowed to operate based on land use classification (e.g. commercial resort, residential multi-family); define operational standards for this type of business; establish a registration process; process non-conforming use certificates and special permits; and enforce the Zoning Code related to this type of use. Ordinance 2018-114 creates a special fund tobe known as the.Short Term Vacation Rental Enforcement Fund. This account shall be funded by all fees and fines collected in connection with the administration and enforcement of this ordinance, and funds in this account shall be utilized to pay for expenses that facilitate enforcement of this ordinance.
