Testimony regarding the proposed "Bill 108, Rule 23" concerning short-term vacation rentals ("STVRs") :
I challenge all members of the Hawaii County Council who support this proposal to prove that its ideas did NOT come
from those would would like to see as few vacation rentals as possible.
• Several proposals would likely lead to lawsuits that our County could ill-afford. Please drop these. These
include:
o Requiring managers to be "reachable" by phone within an hour and be on-site within three hours.
They are not emergency first-responders! 3(j)
o Requiring a second notice (to an already-onerous first notice). 15(b)
o Requiring publication in two newspapers. 15(b-5)
o Invalidation of existing PUDs. 7(c)
o Invalidation of existing covenants concerning STVRs. 7(d)
o Attempting to determine legally the "character of a neighborhood." 6(c)
o Attempting to determine legally the definition of"ongoing basis." 10(c-5)
o Giving unlimited authority to the Director. 11(d-6)
o Allowing the Director to determine the number of STVRs that are allowed. 16(g-1)
o Disallowing a wedding. 6(d-1D)
o Attempting to determine legally the definition of"special performances, and the like". 6(d-1D)
o Requiring all guest parking to be off-street. 6(f)
o Late application for renewal constituting forfeiture and ineligibility for renewal! No exceptions of
any kind listed for this! 12(d)
o STVR must be used within every year, or renewal application will be denied. 12(e-5)
o Approval or denial of applications due to unspecified "other information." 16(c)
• The proposal to require a "list of the names, addresses, and tax map keys of all owners and lessees of
record . . . within 300 feet" and "proof of service or of good faith efforts to serve notice" is onerous and
problematic. What database has such addresses kept up-to-date?—certainly not the County's. Who will
determine the legal definition of"good faith efforts"? 11(d-3,5)
• A"scale drawing on 11x17 paper" sounds like a school project. Who is doing the grading? What are that
person's qualifications? And if the project needs to be done by licensed professionals, such costs would likely
end up in high four-figures, an onerous amount. Ditto for the requirement for a "floor plan, drawn to
scale." 10(c-7,8,9,10)
• Operators of pre-existing STVRs should not have to "apply"; rather, they should register. 8(b-1)
High-cost money proposals, such as for registration, certificate renewal, and site inspection --- and possibly scale
drawings---seem to stem from someone who REALLY DOESN'T WANT Short-Term Vacation Rentals.
The proposals listed in Rule 23 seem to be written by forces intent on preventing visitors from staying at
STVRs. Council Members, please discard these unfair proposals. Comm. No. 50 .4-
